THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, retroactive award of Board
Certification Pay (BCP) from July 1998 through September 2003.
2. The applicant states that she did not receive BCP from July 1998 to
2003. She did receive BCP after September 2003 until September 2004.
3. The applicant provides copies of her recertification letter from the
American Board of Family Practice, her Physician Portfolio, and her leave
and earning statements from August 1998 through September 2003.
CONSIDERATION OF EVIDENCE:
1. The applicant's military records were not submitted to the Board.
Information herein was obtained from the advisory opinion rendered by the
Chief, Army Medical Department (AMEDD) Special Pay Branch, Falls Church,
Virginia, that shows the applicant did not receive BCP for the period 11
July 1997 through 30 September 2003, even though official documentation
indicated certification during this period and she was eligible for the
entitlement.
2. The Chief, AMEDD Special Pay Branch, Office of The Surgeon General,
expressed the opinion that there is no record of the applicant's
certification for the period July 1998 through September 2003 being
received by that office for action. A review of the applicant's military
pay account indicated that office started the applicant's BCP based on
recently submitted documentation as of 1 October 2003, which expired on
31 December 2004. The applicant did not receive BCP for the period 11
July 1997 through 30 September 2003 and official documentation indicated
certification during this period. That office cannot initiate BCP for
this period because the period of arrears exceeds their authority as
granted by the Defense Finance and Accounting System – Indianapolis
Center. In view of the foregoing, it was recommended the applicant
receive BCP in arrears for the period 11 July 1997 through 30 September
2003 utilizing a Health Professions Pay Entry Date or finance Medical
Services-Pay-Date of 16 May 1987, for the correct pay rate level. It was
also recommended that if the applicant has recertified since expiration
of BCP for 31 December 2004, documentation of renewal be provided through
her local military personnel officer and forwarded to the AMEDD Special
Pay Branch to restart BCP.
3. The opinion was forwarded to the applicant for acknowledgement and
possible rebuttal on 16 February 2005. She concurred with the opinion on
25 February 2005.
DISCUSSION AND CONCLUSIONS:
1. The evidence shows the applicant received certification for the period
11 July 1997 through 30 September 2003 and it appears the applicant did not
receive BCP for this period.
2. In view of the facts in this case, the applicant is entitled to
payment of BCP in arrears for the period 11 July 1997 through 30
September 2003 utilizing a Health Professions Pay Entry Date or finance
Medical Services-Pay-Date of 16 May 1987, for the correct pay rate level.
3. If the applicant has recertified since expiration of her BCP for 31
December 2004, she should provide documentation of renewal through her
local military personnel officer and forward it to the AMEDD Special Pay
Branch to restart her BCP.
4. In view of the foregoing, the applicant's records should be corrected
as recommended below.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to
warrant a recommendation for relief. As a result, the Board recommends
that all Department of the Army records of the individual concerned be
corrected by awarding her payment of BCP in arrears for the period 11
July 1997 through 30 September 2003 utilizing a Health Professions Pay
Entry Date or finance Medical Services-Pay-Date of 16 May 1987, for the
correct pay rate level.
