THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show he was deployed overseas in the United Arab Emirates (UAE).

2.  The applicant states he served a 10-month combat tour in the UAE under Operation Enduring Freedom which is not shown on his DD Form 214. 

3.  The applicant provides:

* U.S. Army Installation Management Command, Headquarters, U.S. Army Garrison, Fort Bragg, Orders 175-049 (temporary change of station orders with an attached listing of personnel)
* North Atlantic Treaty Organization (NATO) Orders Number 175-049
* 1st Battalion, 77th Air Defense Artillery Battalion (Patriot) Memorandum
* Soldier Deployment History Outprocessing Report
* DD Form 214

CONSIDERATION OF EVIDENCE:

1.  On 22 August 2007, the applicant enlisted in the Regular Army.  He completed training, was awarded military occupational specialty 94S (Patriot System Repairer), and was promoted to pay grade E-5.


2.  Orders Number 175-049, dated 24 June 2009, issued by U.S. Army Installation Management Command, Headquarters, U.S. Army Garrison, Fort Bragg, show his unit received temporary change of station orders for the U.S. Army Central Command (USCENTCOM) Area of Responsibility (AOR) Afghanistan, effective 1 October 2009, for a period of 365 days.  An attached listing of personnel contains the applicant's name.  These orders are contained in the applicant's records.  

3.  He provides NATO Travel Order 175-049, dated 24 June 2009, showing an expected departure date of 10 October 2009 and an expected return date of 10 October 2010.  These orders list his rank, name, and social security number across the top of the document.

4.  He provides a 1st Battalion, 77th Air Defense Artillery Battalion (Patriot) memorandum, subject:  Statement of Service, dated 9 July 2010.  The memorandum states those listed on the attached orders were authorized the Shoulder Sleeve Insignia-Former Wartime Service, Overseas Service Bar, Overseas Service Ribbon, and Global War on Terrorism Expeditionary Medal for service in Bahrain/UAE from 2 October 2009 through 15 July 2010.

5.  A Soldier Deployment History Outprocessing Report, dated 2 April 2012, covering the period 1 August 2007 to 2 April 2012 shows he was credited with being present for duty 281 days in a named contingency operation from 7 October 2009 to 15 July 2010.

6.  He was released from active duty on 21 August 2012 after completion of required active service.  He completed 5 years of active service during this period.

7.  Item 12f (Foreign Service) of his DD Form 214 shows 9 months and 14 days of foreign service.  Item 18 (Remarks) does not show the requested deployed service.

8.  During the processing of this case the Defense Finance and Accounting Service (DFAS) confirmed through the Soldier's Master Military Pay Account he received hostile fire pay/imminent danger pay and combat zone tax exclusion from 7 October 2009 through 15 July 2010.

9.  Army Regulation 635-5 (Separation Documents) provides detailed instructions for completing separation documents, including the DD Form 214.  It states for item 18, for an active duty Soldier deployed with his or her unit during their continuous period of active service, enter the statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD)."

DISCUSSION AND CONCLUSIONS:

Unit temporary change of station orders with an attached listing including his name show he was ordered to deploy to the USCENTOM AOR from October 2009 to October 2010.  A Soldier Deployment History Outprocessing Report provided by the applicant and information received from DFAS show he deployed during the period 7 October 2009 through 15 July 2010.  Based on a 1st Battalion, 77th Air Defense Artillery Battalion memorandum, subject:  Statement of Service, he provides, it appears he was deployed to Bahrain/UAE during this period.  Therefore, it would be appropriate to correct his DD Form 214 by showing he was deployed to Bahrain/UAE during the period 7 October 2009 through 15 July 2010.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to item 18 of his DD Form 214 the entry "SERVICE IN BAHRAIN/UNITED ARAB EMIRATES FROM 20091007 - 20100715."
