RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2009-00135 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: She be awarded all awards and decorations given to her unit while deployed to the United Arab Emirates (UAE). _________________________________________________________________ APPLICANT CONTENDS THAT: She was asked to separate due to pregnancy and did not receive any awards or decorations before she was released. In support of her request, the applicant provided a copy of her Report on Individual Personnel (RIP) and her DD Form 214, Certificate of Release or Discharge from Active Duty. Applicant’s complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant was an AFR officer who entered active duty on 17 December 1985. She served as a Transportation Officer. On 11 January 1991, the applicant was honorably released from active duty. She served 5 years and 5 days on active duty and was credited with 3 months and 4 days of prior active service. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPAPP recommends denial. DPAPP states a thorough review of the applicant's master personnel record and documents provided by the applicant failed to provide any document that substantiated any time served in the United Arab Emirates. There is no evidence she was on temporary duty (TDY) or assigned to this location. The DPAPP complete evaluation, with attachment, is at Exhibit B. AFPC/DPSIDR recommends denial. DPSIDR states after a review of her record they are unable to verify the applicant's service in the UAE. In addition, the Defense Finance and Accounting Service (DFAS) was also unable to verify her deployment location. However, they were able to determine the applicant's entitlement to the Air Force Outstanding Unit Award. The DPSIDR complete evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 24 July 2009, copies of the Air Force evaluations were forwarded to the applicant for review and comment within 30 days (Exhibit D). As of this date, this office has received no response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. The applicant’s contentions are duly noted; however, after reviewing the evidence of record we agree with the opinions and recommendations of the Air Force offices of primary responsibility and adopt their rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice. There are no documents in the applicant’s military personnel record which reflect she served in the UAE (i.e., stationed or sent TDY during her tour of duty in the Air Force).
