		BOARD DATE: 13 December 2012

		DOCKET NUMBER: AR20120010432

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty), to show his primary military occupational specialties (MOS) and military education courses.

2. The applicant states his present DD Form 214 does not show the military education that was shown on his previous DD Form 214. His primary specialties of 25L (Cable Systems Installer-Maintainer) and 42A (Human Resources Specialist) are also not listed.

3. The applicant provides a copy of his:

* DD Form 214 for the period ending 6 November 2006
* orders awarding him MOS 25L
* DD Form 214 for the period ending 17 September 2004

CONSIDERATION OF EVIDENCE:
1. Following prior service in the U.S. Army Reserve the applicant enlisted in the Regular Army on 3 March 2005 for training in MOS 25L.
2. The applicant was honorably discharged on 6 November 2006 due to disability. He had completed 1 year, 8 months, and 4 days of creditable during the period covered by the DD Form 214. Item 11 (Primary Specialty) shows "NONE//NOTHING FOLLOWS." Item 14 (Military Education) shows "NONE//NOTHING FOLLOWS."
3. The applicant’s medical evaluation board/physical evaluation board proceedings are not available.

4. In support of his application, he provides:

	a. DD Form 214 for the period 3 March 2005 to 6 November 2006.

	b. Headquarters, United States Army Signal Center and Fort Gordon, Orders 109-167, dated 19 April 2005. These orders show:

		(1) Awarded: P25L1O0000

		(2) Effective Date: 23 May 2005 or upon completion of training and award of required security clearance.

	c. DD Form 214 for the period 7 July 2004 to 17 September 2004. Item 11 shows: "42A1O HUMAN RESOURCES SPECIALIST–0 years – 0 MOS//NOTHING FOLLOWS." Item 14 shows: "HUMAN RESOURCES SPECIALIST, 8 WEEKS, SEP 2004//NOTHING FOLLOWS."

5. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. The DD Form 214 is a summary of a Soldier's most recent period of continuous active service (emphasis added).

	a. Item 11 shows the titles of all MOS's served for at least 1 year and includes the number of years and months served for each MOS.

	b. item 14 shows formal in-service (full-time attendance) training courses
successfully completed during the period of service covered by the DD Form 214.

DISCUSSION AND CONCLUSIONS:

1. There is no available evidence showing the applicant completed the training required for MOS 25L or that he was awarded the required security clearance. His medical evaluation board/physical evaluation board proceedings are not available, so it cannot be determined if those board actions started while he was in training, which could have prevented his completing the training. His DD Form 214 ending 6 November 2006 should not be corrected to show his MOS as 25L or that he completed the required training at this time.

2. Since the applicant enlisted for training in a new MOS, there is insufficient evidence to show he held MOS 42A at the time he enlisted in March 2005. He completed Human Resources Specialist training in 2004 and it is shown on his DD Form 214 covering that period of active service.

3. In view of the foregoing, there is no basis for granting the applicant's request.

The applicant requests item 11 (Primary Specialty) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected. His AARTS transcript shows he held primary MOS 88M2O from February 2005 to present [6 November 2006, his separation date] for a total of 1 year and 8 months. Therefore, item 11 of his DD Form 214 should be corrected to show he served in MOS 42A2O for 3 years and 2 months and in MOS 88M2O for 1 year and 8 months.

The evidence of record also shows that the applicant entered active duty in MOS 75H as a USAR (reserve component) Soldier and member of the AGR Program. The evidence of record shows that the applicant was discharged from active duty on 19 May 2004. Therefore, the applicant's records should be corrected to show that at the time of her discharge, she held MOS 75H2O (Personnel Services Specialist) as her primary specialty for 3 years and 5 months.

Item 11 of his DD Form 214 should state he served in MOS 11B during his entire period of enlisted service which equals 4 years, 3 months, and 18 days. Chapter 2 contains guidance on the preparation of the DD Form 214 and states item 11, show the titles of all MOS's served for at least 1 year and include for each MOS the number of years and months served. The available evidence shows the applicant was trained in and awarded MOS 11B.

The applicant’s discharge packet, dated May 2003, shows her MOS was 75B. DISCUSSION AND CONCLUSIONS: Although the applicant requests that the MOS 25B entry in item 11 on her DD Form 214 for the period ending 10 June 2003 be changed to show MOS 42A, evidence of record shows she enlisted in MOS 75B and that her MOS was 75B at the time of her separation from active duty on 10 June 2003. Therefore, item 11 on her DD Form 214 for the period ending 10 June 2003 should be corrected to show she...

The applicant provides: * DD Form 214 * Enlisted Record Brief (ERB) CONSIDERATION OF EVIDENCE: 1. Since the governing regulation instructs the DD Form 214 preparer not to count basic training and AIT as creditable time spent in a particular MOS, it is reasonable to presume he held primary MOS 94F for 3 years and 4 months, which is properly shown in item 11 of his DD Form 214. Although he contends he served in MOS 42A for 3 years and 4 months, there is no evidence of record and he provided...
