THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Joint Service Achievement Medal (JSAM) and Meritorious Service Medal (MSM).

2.  She also states that per the letter from the Board, dated 12 May 2011, she is enclosing orders and documents authorizing and announcing the requested awards.  She was awarded the JSAM subsequent to the receipt of her DD Form 214.  She thanks the Board in advance for reviewing her case again.

CONSIDERATION OF EVIDENCE:

1.  The applicant’s military record shows after having prior active and Reserve component service, she was ordered to active duty in support of Operation Noble Eagle as a member of the U.S. Army Reserve.  She held the rank of sergeant first class (SFC) and served until she was honorably released from active duty by reason of completion of required active service on 12 January 2005.

2.  The DD Form 214 issued upon her REFRAD shows she completed 2 years of creditable service for the period it covered (13 January 2003 – 12 January 2005). Item 13 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized) does not include the MSM or JSAM.

3.  The applicant provides DIA, Military Personnel Award Order Number 031-4, dated 31 January 2005.  It announced her award of the JSAM for the period October 2003 to January 2005.

4.  The applicant provides a copy of the JSAM certificate dated 25 January 2005. It specifically shows she received this award for her meritorious service during the period 1 October 2003 through 4 January 2005.

5.  The applicant provides an MSM certificate awarding her the MSM for a period ending on 15 November 2006.

6.  Army Regulation 635-5 (Separation Documents) prescribes the separation documents that are prepared for individuals upon retirement, discharge, or release from active military service or control of the Army.  It also establishes standardized policy for preparing and distributing the DD Form 214.  The 
DD Form 214 is a summary of a Soldier's most recent period of continuous active duty.  Item 13 of the DD Form 214 will contain all awards and decorations for all periods of service and each entry will be verified by the Soldier's records.

DISCUSSION AND CONCLUSIONS:

1.  The evidence of record confirms the applicant was awarded the JSAM for meritorious service from 1 October 2003 through 4 January 2005, and this award was announced in official orders.  Therefore, item 13 of her DD Form 214 issued on 12 January 2005 should be corrected to reflect the JSAM.

2.  The evidence of record confirms the applicant's DD Form 214 covered the period 13 January 2003 - 12 January 2005 and she was subsequently awarded the MSM for a period ending on 15 November 2006.  By regulation, the DD Form 214 is a summary of the period of active duty it covers.  There are no provisions for adding the MSM to the applicant's DD Form 214 because it was awarded to her subsequent to the period it covered.  Accordingly, this portion of the requested relief should not be granted.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the JSAM to item 13 of the her DD Form 214 issued 12 January 2005 and providing her a correction to this document to reflect this correction.

2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to adding the Meritorious Service Medal to the applicant's DD Form 214.
