THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that her DD Form 214 (Certificate of Release or Discharge from Active Duty), dated 28 February 1994, be corrected to reflect in block 12a that she entered active duty on 5 October 1989 instead of 1 April 1985.

2.  The applicant states her DD Form 214 incorrectly reflects that she entered active duty this period on 1 April 1985 instead of 5 October 1989 which has caused difficulty in determining her correct retirement points.

3.  The applicant provides copies of her DD Form 214, DA Form 71 (Oath of Office), and DD Form 220 (Active Duty Report). 

CONSIDERATION OF EVIDENCE:

1.  The applicant was appointed as a second lieutenant in the U.S. Army Reserve on 1 April 1985. 

2.  She was ordered to active duty on 5 October 1989 in the rank of captain for a period of 3 years and she was transferred to Fort Sam Houston, Texas to attend the officer basic course as an Army nurse.

3.  She completed her training and was transferred to Germany where she remained until she was honorably released from active duty (REFRAD) on 28 February 1994 under the early release program – voluntary separation incentive program.  She had served 4 years, 4 months, and 24 days of active service and 4 years, 6 months, and 4 days of prior inactive service.
4.  However, the applicant's DD Form 214 issued at the time of her REFRAD shows she entered active duty on 1 April 1985 and that she served 8 years, 10 months, and 28 days of active service and had no prior inactive service.

5.  On 13 October 1998, she was again ordered to active duty in the rank of major for a period of 3 years and she has remained on active duty.  She was promoted to the rank of lieutenant colonel on 1 August 2005.

6.  Army Regulation 635-5 serves as the authority for the preparation of the 
DD Form 214.  It provides, in pertinent part, that the DD Form 214 will be prepared to reflect information contained in official records in effect at the time the DD Form 214 is prepared.

DISCUSSION AND CONCLUSIONS:

1.  The applicant’s contention that block 24a of her DD Form 214, dated
28 February 1994, incorrectly reflects that she entered active duty this period on 1 April 1985 instead of 5 October 1989 has been noted and found to have merit.

2.  The evidence of record shows she entered active duty on 5 October 1989 and served until she was honorably REFRAD on 28 February 1994.  She had served 4 years, 4 months, and 24 days of active service and 4 years, 6 months, and
4 days of prior inactive service.

3.  Accordingly, her DD Form 214 should be corrected to reflect the correct information in blocks 12a, 12c, and 12e.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

* Deleting the entry “85  04  01” from block 12a of her DD Form 214
* Entering the entry “89  10  05” in 12a of her DD Form 214
* Deleting the entry “08  10  28” from block 12c of her DD Form 214
* Entering the entry “04  04  24” in block 12c of her DD Form 214
* Deleting the entry “00  00  00” from block 12e of her DD Form 214
* Entering the entry “04  06  04” in block 12e of her DD Form 214
