THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that her DD Form 214 (Certificate of Release or Discharge from Active Duty) dated 28 February 1994 be corrected to show in block 7b that her Home of Record (HOR) was 237 Schermerhorn Street, Schenectady, New York 12304 and that block 12a be corrected to show that she entered active duty on 5 October 1989.

2.  The applicant states that the Board approves of the changes in a letter dated 13 January 2012.  She also states that the DD Form 214 requires that a complete address be entered in block 7b if it is known.

3.  The applicant provides a copy of a 13 January 2012 letter from the Board and copies of her accession and discharge orders. 

CONSIDERATION OF EVIDENCE:

1.  The applicant was appointed as a second lieutenant in the U.S. Army Reserve on 1 April 1985.

2.  She was ordered to active duty on 5 October 1989 in the rank of captain for a period of 3 years.  A review of her official records shows no indication of the applicant’s home of record.  However, it does show that her father lived at 237 Schermerhorn Street, Schenectady, New York 12304 at the time.

3.  She completed her training and was transferred to Germany where she remained until she was honorably released from active duty (REFRAD) on 28 February 1994 under the early release program – voluntary separation incentive program.  She had served 4 years, 4 months, and 24 days of active service and 4 years, 6 months, and 4 days of prior inactive service.

4.  Her DD Form 214 issued at the time of her REFRAD shows in block 7b that her HOR was “New York” and in block 12a that she entered active duty this period on “850401”.  It also shows that her mailing address after separation was her father’s address.

5.  The applicant applied to the Board requesting that her DD Form 214 be corrected to show that she entered active duty on 5 October 1989.  The Board approved her request on 12 January 2012 (Docket # AR20110020088) `and issued a DD Form 215 to reflect a changed to the date she entered active duty.  Accordingly, the issue of the date in block 12a has already been addressed by the Board and will not be discussed further in these proceedings.

6.  Army Regulation 635-5 (Separation Documents) serves as the authority for the preparation of the DD Form 214.  It provides, in pertinent part, that the complete address will be entered in block 7b (Home of Record) if known.

DISCUSSION AND CONCLUSIONS:

1.  Although the applicant’s HOR is not recorded in her official records, it is reasonable to presume that she used her father’s address as her HOR at the time because it is also the address she provided as her contact address after her REFRAD.

2.  Accordingly, her 28 February 1994DD Form 214 should be corrected to show that her HOR in block 7b was 237 Schermerhorn Street, Schenectady, New York 12304.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

* Deleting the entry “New York” from block 7b of her DD Form 214 dated 28 February 1994
* Adding the entry “237 Schermerhorn Street, Schenectady, New York 12304” to block 7b of her DD Form 214 dated 28 February 1994
