		IN THE CASE OF:

		BOARD DATE: 20 December 2011

		DOCKET NUMBER: AR20110012344

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show he served 3 years, 6 months and 6 days of active service instead of the 2 years, 6 months, and 6 days as shown on his DD Form 214.

2. The applicant states he entered the U.S. Army in 2007, not 2008; therefore, he should have 1 more year on his DD Form 214.

3. The applicant provides a copy of his DD Form 214.

CONSIDERATION OF EVIDENCE:

1. The applicant record contains a DD Form 4 (Enlistment/Reenlistment Document - Armed Forces of the United States) that shows the applicant enlisted in the U.S. Army Reserve (USAR) Delayed Entry Program (DEP) on 7 March 2008 for a period of 8 years. He was discharged from the USAR DEP on
31 March 2008 and he enlisted in the Regular Army (RA) on 1 April 2008 for a period of 3 years and 16 weeks.

2. On 6 October 2010, the applicant was discharged. The DD Form 214 he was issued at the time shows in:

	a.  item 12a (Date Entered Active Duty This Period) the entry "2008 04 01" [1 April 2008];

	b.  item 12b (Separation Date This Period) the entry "2010 10 06" [6 October 2010];

	c. item 12c (Net Active Service This Period) the entry "0002 06 06" [2 years, 6 months, and 6 days]; and

	d. item 21a (Member Signature) he electronically signed the document on
6 October 2010.

3. Army Regulation 635-5 (Personnel Separations - Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army. It also establishes standardized policy for preparing and distributing the DD Form 214.

	a. Chapter 2 contains guidance on the preparation of the DD Form 214. It states the source documents for entering information on the DD Form 214 will be the Enlisted Record Brief, separation approval authority documentation, separation orders, or any other document authorized for filing in the Official Military Personnel File (OMPF).

	b. Paragraph 2-4 (Completing the DD Form 214) contains item-by-item instructions for completing the DD Form 214. Item 12 states use extreme care in completing this block since post-service benefits, final pay, retirement credit, and so forth are based on this information. It also states for:

* item a, enter the beginning date of the continuous period of active duty for issuance of this DD Form 214, for which a DD Form 214 was not previously issued
* item b, enter the Soldier's transition date (this date may not be the contractual date, if Soldier is separated early)
* item c, enter the amount of service this period, computed by subtracting item 12a from 12b

DISCUSSION AND CONCLUSIONS:

1. The applicant contends his DD Form 214 should be corrected to show he entered active duty 1 year earlier (i.e., on 1 April 2007) and that he completed
1 additional year of active service.

2. The governing Army regulation states that the entry in item 12a will be the beginning date of the continuous period of active duty for the DD Form 214.

3. Records show the applicant entered active duty in the RA on 1 April 2008.

4. The applicant's DD Form 214 shows his period of active duty service from
1 April 2008 through 6 October 2010. It also shows his net active service for the period covered (i.e., 2 years, 6 months, and 6 days). Therefore, the applicant's
DD Form 214 correctly shows the period of his creditable active service.

5. In view of the foregoing, there is no basis for granting the applicant's request.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

However, there is no evidence in his records that show he was awarded MOS 25F or that he was issued a DD Form 214 for this period of service. He then completed 6 months and 10 days when he was ordered to active duty on 1 August 2006 (the DD Form 215 adjusted this date to 28 July 2006) and he was released from active duty on 7 February 2007. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge.
