		IN THE CASE OF:

		BOARD DATE:	20 January 2011

		DOCKET NUMBER: AR20100018206

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of item 12a (Date Entered Active Duty this Period) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to read "4 June 2007."

2. The applicant states he was not present when his DD Form 214 was processed; the worksheet was done over the phone.

3. The applicant provides his DD Form 214 and Orders 152-339, issued by the Texas Military Forces, Army National Guard, Austin, TX, dated 1 June 2007.

CONSIDERATION OF EVIDENCE:

1. After having had prior U.S. Navy service, the applicant enlisted in the Texas Army National Guard (TXARNG) on 11 March 1994.

2. Orders 152-339, dated 1 June 2007, ordered him to active duty in support of Operation Iraqi Freedom (OIF) for a period not to exceed 400 days, effective
4 June 2007.

3. The Defense Finance and Accounting Service (DFAS) records show he reported for active duty on 4 June 2007 and he was released from active duty on 11 May 2008.

4. Records show he was honorably released from active duty on 11 May 2008. His DD Form 214 shows in:

	a. Item 12a the entry "2004 06 04" (4 June 2004)

	b. Item 12b (Separation Date This Period) the entry "2008 05 11" (11 May 2008)

	c. Item 12c (Net Active Service This Period) the entry "0000 11 08
(11 months and 8 days)

5. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. The regulation provides that the beginning date of the continuous period of active duty for which the DD Form 214 is being issued be entered in item 12a of the DD Form 214. This regulation also provides that the date of separation be entered in item 12b and that the net service for the period shown would be computed by subtracting item 12a from item 12b and then deducting any time lost and non-creditable service after the Soldier's expiration of term of service.

DISCUSSION AND CONCLUSIONS:

The applicant's personnel and DFAS records show he was mobilized in support of OIF from 4 June 2007 through 11 May 2008. Therefore, he is entitled to correction of item 12a of his DD Form 214 to show he entered active duty this period on 4 June 2007.

BOARD DETERMINATION/RECOMMENDATION:

As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting from item 12a of his DD Form 214 the entry "2004 06 04" and replacing it with the entry "2007 06 04."

However, there is no evidence in his records that show he was awarded MOS 25F or that he was issued a DD Form 214 for this period of service. He then completed 6 months and 10 days when he was ordered to active duty on 1 August 2006 (the DD Form 215 adjusted this date to 28 July 2006) and he was released from active duty on 7 February 2007. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge.
