THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show completion of the Military Working Dog Course.
2. The applicant states, in effect, that he completed the 10-week Military Working Dog Course in January 2002; however, it is not reflected on his
DD Form 214.
3. The applicant provides a copy of his Enlisted Record Brief and a copy of his student training report showing his completion of the Military Working Dog Course.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicants failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant enlisted in the Regular Army on 22 November 1995. He completed his training as a military policeman and remained on active duty through a series of continuous reenlistments. He was promoted to the pay grade of E-5 on 12 April 2002.
3. The applicant attended and completed the 10-week military working dog course from 22 October 2001 to 17 January 2002 and was subsequently assigned as Narcotic Detector Dog Handler at Fort Hood, Texas.
4. On 20 October 2004, he was honorably discharged. His DD Form 214 issued at the time of discharge shows he competed the Primary Leadership Development Course, 4 weeks, 2000.
DISCUSSION AND CONCLUSIONS:
1. The applicants contentions that his DD Form 214 should be corrected to reflect completion of the Military Working Dog Course has been noted and found to have merit.
2. The applicant completed the Military Working Dog Course, 10 weeks, in 2002. Accordingly, he is entitled to have this training added to his DD Form 214 at this time.
