THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show he completed military police (MP) one-station unit training (OSUT) (basic combat training and advanced individual training) and he was awarded or authorized the National Defense Service Medal (NDSM), Global War on Terrorism Service Medal (GWOTSM), Army Service Ribbon (ASR), and Marksman Marksmanship Qualification Badge with Rifle and Pistol Bars.

2.  The applicant states he earned or was awarded these items.

3.  The applicant provides his DA Form 5286-R (Individual Training Record), DA Form 3595-R (Record Fire Scorecard), MP OSUT diploma, DA Form 705 (Army Physical Fitness Test Scorecard), and DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  The applicant's military records show he enlisted in the Regular Army on 30 December 2008 and entered MP OSUT on 6 January 2009.

2.  The DA Form 5286-R submitted by the applicant shows his commander certified he completed all training requirements for MP OSUT; the MP OSUT diploma shows he attended MP OSUT from 9 January to 21 May 2009 and graduated; and the DA Form 3595-R shows he passed his physical fitness test on 10 May 2009.

3.  On 15 June 2009, an Entrance Physical Standards Board convened and determined the applicant was medically disqualified under procurement standards.

4.  Accordingly, he was honorably discharged on 15 September 2009 under the provisions of Army Regulation 635-200 (Enlisted Separations), paragraph 5-11, for failing medical/physical/procurement standards.  He completed 8 months and 16 days of active service.  His DD Form 214 contains in item 11 (Primary Specialty) the entry, "NONE//NOTHING FOLLOWS"; in item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) the entry, "NONE//NOTHING FOLLOWS"; and in item 13 (Military Education) the entry, "NONE//NOTHING FOLLOWS."

5.  The DA Form 3595-R shows the applicant qualified as Marksman with an unknown weapon.

6.  Army Regulation 600-8-22 (Military Awards) states all Soldiers on active duty, on or after 11 September 2001 to a date to be determined having served 30 consecutive days or 60 nonconsecutive days are authorized the GWOTSM.  

7.  Army Regulation 600-8-22 states that effective 1 August 1981 an individual is qualified for the ASR after completion of a military occupational specialty (MOS)-producing course.

8.  Army Regulation 600-8-22 states the NDSM is awarded for honorable active service for any period between 27 June 1950 and 27 July 1954, both dates inclusive; between 1 January 1961 and 14 August 1974, both dates inclusive; between 2 August 1990 and 30 November 1995; and 11 September 2001 and a date to be determined.

DISCUSSION AND CONCLUSIONS:

1.  The evidence conclusively shows the applicant completed MP OSUT and was awarded MOS 31B.  As such, it would be appropriate to add that training and MOS to his DD Form 214.

2.  Based on the dates of his active service, he is entitled to the NDSM and the GWOTSM.

3.  Since he was awarded an MOS, he is also entitled to the ASR.

4.  As for the marksmanship qualification badge, while the applicant provides evidence that he qualified as Marksman, there is no indication which weapon was used in that qualification.  As such, there is insufficient evidence with which to grant this portion of his request.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 as follows:

	a.  Item 11 – delete "NONE//NOTHING FOLLOWS" and add "31B1O, MILITARY POLICE, 4 MONTHS";

	b.  Item 13 – delete "NONE//NOTHING FOLLOWS" and add "NDSM, GWOTSM, ASR"; and

	c.  Item 13 – delete "NONE//NOTHING FOLLOWS" and add "MP OSUT, 19 WEEKS, MAY 2009."

2.  The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to the marksmanship qualification badge.
