THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that his separation document, DD Form 214, be amended to add the Army Service Ribbon (ASR), National Defense Service Medal (NDSM), Global War on Terrorism Service Medal (GWOTSM), Sharpshooter Marksmanship Qualification Badge with Rifle Bar, and Expert Marksmanship Qualification Badge with Grenade Bar.

2.  The applicant states he was given the awards while in advanced individual training.

3.  The applicant provides the approved personnel action advancing him to pay grade E-2, his DD Form 214, and pages from the internet which pertain to the awards he is requesting in support of his application.

CONSIDERATION OF EVIDENCE:

1.  The applicant's military records show that he enlisted in the Regular Army on 9 August 2007; he was advanced to pay grade E-2; and he was honorably discharged on 28 April 2008 under the provisions of Army Regulation 635-200, paragraph 5-17, by reason of a condition, not a disability.

2.  The DD Form 214 the applicant was issued has "NONE/NOTHING FOLLOWS" in Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized.)  Item 11 (Primary Specialty), has "NONE/NOTHING FOLLOWS" entered.  Item 14 (Military Education), has "NONE/NOTHING FOLLOWS" entered.
3.  Army Regulation 600-8-22 (Military Awards) prescribes the Army's awards policy.  It provides, in pertinent part, that the NDSM is awarded for honorable active service for any period between 27 July 1950 through 27 July 1954,
1 January 1961 through 14 August 1974, 2 August 1990 through 30 November 1995, and 11 September 2001 to a date to be determined.

4.  Army Regulation 600-8-22 states that effective 1 August 1981, an individual is qualified for the ASR after completion of a military occupational specialty (MOS) producing course.  Officers are normally qualified for the award after completion of their basic/orientation or higher level course.  An individual's MOS based on skills acquired in another service or in civilian training is qualified after 4 months active duty.  The award may be granted retroactively to those who qualified prior to 1 August 1981 only if they had an active Army status after that date.

5.  Army Regulation 600-8-22, paragraph 2–19, Global War on Terrorism Service Medal, states that the GWOTSM was established by Executive Order 13289, 12 March 2003.  It is authorized for award to members of the Armed Forces of the United States who have participated in the Global War on Terrorism (GWOT) operations outside of the designated areas of eligibility (AOE) defined in 2–18g above, on or after 11 September 2001 to a future date to be determined.  Service members must be assigned, attached, or mobilized to a unit supporting designated operations listed in 2–18g for 30 consecutive days or for 60 nonconsecutive days, or meet one of the following criteria:

   a.  Initial award of the GWOTSM.  Limited to airport security operations (from 27 September 2001 through 31 May 2002) and Soldiers who supported Operations NOBLE EAGLE, ENDURING FREEDOM, and IRAQI FREEDOM.

   b.  All Soldiers on active duty, including Reserve Component Soldiers mobilized, or National Guard Soldiers activated on or after 11 September 2001 to a date to be determined having served 30 consecutive days or 60 nonconsecutive days are authorized the GWOTSM.

DISCUSSION AND CONCLUSIONS:

1.  Since the applicant served on active duty during the specified period for award of the NDSM and the GWOTSM, he is entitled to have these awards added to his DD Form 214.

2.  Since the applicant was never awarded an MOS, he is not entitled to the ASR.

3.  The applicant's military records do not contain any orders awarding him any Marksmanship Badges.  As such, there is insufficient evidence in which to grant this portion of his request.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 to add the NDSM and the GWOTSM.

2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to the addition of the ASR and marksmanship qualification badges to his DD Form 214.
