		IN THE CASE OF:

		BOARD DATE: 08 June 2010

		DOCKET NUMBER: AR20100007011

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that his 17 March 1990 DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to include the time he spent in basic training.

2. The applicant states his enlistment agreement in the U.S. Army Reserve (USAR) provided for initial active duty for training (IADT) in two separate summer sessions between school terms. When he reentered active duty, his prior active duty was miscalculated in that the time in basic training was not counted.

3. The applicant provides copies of his 3 October 1983 enlistment documents, initial DA Form 2-1 (Personnel Qualification Record - Part II), 24 June 1982 and 17 March 1990 DD Forms 214, and a 23 December 2008 Statement of Service.

CONSIDERATION OF EVIDENCE:

1. The applicant is currently serving on active duty as a Regular Army Nurse Corps major. He began his Army career on 6 June 1981 when he first enlisted in the USAR.

2. According to his original DA Form 2-1, he completed basic training from 26 June 1981 to 22 September 1981.

3. He completed his split session IADT between 24 June 1982 and 13 August 1982 and was properly issued his first DD Form 214.

4. That DD Form 214 correctly shows 1 month and 20 days of active duty. It also incorrectly shows 2 months and 26 days of prior active duty [it appears the 1 day for the inclusive date was not added to the subtracted difference] and correctly shows 9 months and 21 days of total prior inactive duty.

5. He enlisted in the Regular Army and served on active duty from 3 November 1983 through 17 March 1990. However, the DD Form 214 for that period shows only 1 month and 20 days of prior active duty. This apparently occurred by overlooking the 2 months and 27 days of basic training and reporting only the second IADT period.

DISCUSSION AND CONCLUSIONS:

1. The applicant states his enlistment agreement in the USAR provided for IADT in two separate summer sessions between school terms. When he reentered active duty, his prior active duty was miscalculated in that the time in basic training was not counted.

2. His 17 March 1990 DD Form 214 is incorrect in that item 12d shows only 1 month and 20 days of prior active duty. This overlooks his 2 months and 27 days in basic training.

3. The applicant's DD Form 214 should be corrected by changing item 12d to read 4 months and 27 days.

BOARD VOTE:

BOARD DETERMINATION/RECOMMENDATION:

Department of the Army records of the individual concerned be corrected by changing item 12d of his 17 March 1990 DD Form 214 to read 4 months and 27 days.

Although documents associated with the applicant’s initial enlistment in the U.S. Army were not available to the Board, the evidence which is available indicates the applicant initially entered military service as a member of the USAR on 2 May 1980 while still in high school. When the applicant was discharged from active duty in June 1987 by reason of permanent physical disability, the entries on his DD Form 214 correctly reflected a total of 5 years, 7 months, and 7 days of active service...

The applicant states, in effect, that his DD Form 214 should be corrected to show his correct active duty time. The evidence shows the applicant enlisted in the Regular Army on 17 June 1975 and continued to serve until he was honorably discharged on 30 January 1978, for immediate reenlistment. Therefore, there is no basis to change item 12b, of his DD Form 214, dated 30 March 1982 to show the entry "82 03 31" (31 March 1982).
