         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that her Certificate of Release or Discharge from Active Duty, DD Form 214, for the period ending 24 June 1991 be corrected to show she had continuous service from 30 April 1981 to 1 July 1991, to add the Volunteer Service Ribbon, to show that she is entitled to wear the numeral 2 with the Noncommissioned Officer Professional Development Ribbon (NPDR), and to add the three unit supply specialist courses she attended.

3. The applicant states that her DD Form 214 for the period ending 24 June 1991 shows she had only 3 years, 5 months, and 11 days of inactive service. It should show she had 9 years and 19 days of inactive service. She also never received a DD Form 214 at the time of her discharge on 1 July 1991. She completed the Basic Noncommissioned Officer Course (BNCOC) so she should have the numeral 2 on her NCOPDR. Also, the Volunteer Service Ribbon is awarded to all members of the Tennessee Army National Guard (TNARNG). In addition, she possessed military occupational specialty (MOS) 76Y (Unit Supply Specialist). She had two additional diplomas for this MOS but most of her papers were destroyed in a house fire. She provides her DD Form 214 for the period ending 9 March 1982, her DD Form 214 for the period ending 24 June 1991, and her BNCOC diploma as supporting evidence.

4. The applicant’s military records show that she enlisted in the U. S. Army Reserve (USAR) on 30 April 1981 for 6 years. She was ordered to initial active duty for training. An Active Duty Report, DD Form 220, shows that she entered active duty (apparently for basic training) on 8 June 1981 and her active duty was terminated on 14 August 1981. Her DD Form 214 for the period ending 9 March 1982 shows that she entered active duty on 24 August 1981 (apparently for advanced individual training) and was released from active duty for training on 9 March 1982 after completing 6 months and 16 days of active service that period.

5. On 1 May 1983, the applicant completed the Basic Course for Reserve Component NCOs. On 1 October 1983, she extended in the USAR for 6 months. Her Personnel Qualification Record, DA Form 2-1, shows she attended a 2-week supply course at Fort Campbell, KY in 1984. A Service School Academic Evaluation Report, DA Form 1059, shows that she attended Unit Supply Specialist Primary Technical Course (76Y20) in a non-resident status and completed it on 17 October 1987.

6. The applicant was discharged from the USAR on 18 October 1987 for the purpose of immediately enlisting in the ARNG on 19 October 1987 for 6 years.

7. On 6 December 1990, the applicant was ordered to active duty in support of Operation Desert Shield/Storm. On 21 May 1991, she was diagnosed as having a personality disorder. On 20 June 1991, her TNARNG company commander recommended her separation for medical reasons with a recommended effective date of separation of 25 June 1991. Her DD Form 214 for this period shows she was released from active duty and transferred to the TNARNG on 24 June 1991. Item 12d of this DD Form 214 shows she had a total of 6 months and 16 days of prior active service. Item 12e of this DD Form 214 shows she had a total of 3 years, 5 months, and 11 days of prior inactive service. Item 13 shows she was awarded the NPDR basic ribbon. Item 14 has no military education listed. Item 18 notes that item 12d does not account for annual and/or weekend training she accomplished prior to 6 December 1990.

8. The applicant was discharged from the ARNG and as a Reserve of the Army on 1 July 1991 for being medically unfit for retention. Her Army National Guard Retirement Points History Statement shows that she had a total of 483 active duty points.

9. Army Regulation 635-5 prescribes the separation documents prepared for soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. In pertinent part it states that the DD Form 214 is a synopsis of the soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge. The instructions for completing item 12d, total prior active service, is to enter all service less time lost. The instructions for completing item 12e, total prior inactive service, is to enter all service less time lost. The instructions for completing item 14, military education, is to list in-service training courses successfully completed during the period of service covered by the DD Form 214.

10. Title 10, U. S. Code, section 101(d) defines “active service” as service on active duty or full-time National Guard duty. “Active duty” is defined as full-time duty in the active military service of the United States. Such term includes full-time training duty, annual training duty, and attendance, while in the active military service, at a school designated as a service school.

11. Army Regulation 600-8-22 prescribes policy and criteria concerning individual military awards. In pertinent part, it states that the NPDR is awarded to Active Army, ARNG and USAR soldiers for successful completion of designated NCO professional development courses. The NPDR consists of the basic ribbon with numeral devices of 2, 3, or 4 which signify satisfactory completion of the respective levels of NCO professional development courses. All Active Army, ARNG, and USAR soldiers in an active status who satisfactorily complete BNCOC are eligible for award of numeral 2.

12. The Volunteer Service Medal is not listed in Army Regulation 600-8-22.


CONCLUSIONS:

1. The applicant completed BNCOC and so is entitled to wear the numeral 2 on the NPDR. Her DD Form 214 for the period ending 24 June 1991 should be amended to show she was awarded the NPDR with numeral 2.

2. The Volunteer Service Ribbon is not listed as an authorized award in Army Regulation 600-8-22 and appears to be an award authorized only for members of the TNARNG. Therefore, it is not authorized for entry on her DD Form 214.

3. There appears to be an error in items 12d and 12e of the applicant’s DD Form 214 for the period ending 24 June 1991. The DD Form 214 is a synopsis of her most recent period of continuous active duty. Since she was released from active duty on 24 June 1991, it properly ends on 24 June 1991. She would not have received a DD Form 214 for the period 25 June - 1 July 1991 since she was not on active duty during this period. However, she was in either the USAR or the ARNG continuously beginning with her enlistment in the USAR on 30 April 1991. Therefore, her total prior inactive service from 30 April 1991 until 24 June 1991 (even minus any active service) is greater than the 3 years, 5 months, and 11 days shown in item 12e. Item 12d shows only the prior active service as taken from her DD Form 214 for the period ending 9 March 1982. Item 12d should also include her prior active service taken from her DD Form 220 plus any annual training she may have performed prior to 6 December 1990.

4. The instructions for completing item 14 of the DD Form 214 call for entering only those in-service training courses successfully completed during the period of service covered by the DD Form 214. One of the three courses mentioned by the applicant appears to have been a 2-week supply course completed in 1984, outside of the period covered by the DD Form 214. Another was the Unit Supply Specialist Primary Technical Course she attended in a non-resident status; therefore, it was not authorized for entry on the DD Form 214. There is no evidence of what the third supply course might have been or when it was completed or in what status (resident or non-resident) it was taken.

5. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That the applicant’s total prior active and total prior inactive service as of 24 June 1991 be recalculated.

2. That once the applicant’s service has been recalculated, her DD Form 214 for the period ending 24 June 1991, item 13 be amended to delete the NCO Professional Development Ribbon and add the NCO Professional Development Ribbon with numeral 2 and items 12d and 12e be amended to show her recalculated total prior active and total inactive service.

3. That so much of the application as is in excess of the foregoing be denied.
