		IN THE CASE OF:

		BOARD DATE: 27 July 2010

		DOCKET NUMBER: AR20100000925

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that her DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show she was awarded the Army Achievement Medal (AAM).

2. The applicant states she received an AAM, dated 29 February 2008.

3. The applicant provides a copy of her DD Form 214.

CONSIDERATION OF EVIDENCE:

1. The applicant's record shows she enlisted in the Regular Army on 20 September 2005. She served 2 years, 6 months, and 10 days and was honorably discharged on 29 March 2008.

2. Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) of the applicant's DD Form 214 does not show award of the AAM.

3. There are no recommendations, certificates, or orders in the applicant's official military personnel file for award of the AAM. Additionally, this award is not listed on her Enlisted Record Brief.

4. Army Regulation 600-8-22 (Military Awards) states the AAM is awarded to any member of the Armed Forces of the United States who, while serving in a non-combat area on or after 1 August 1981, distinguished himself or herself by meritorious service or achievement. As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required.

DISCUSSION AND CONCLUSIONS:

1. In the absence of orders there is insufficient evidence to demonstrate that the applicant was properly awarded the Army Achievement Medal.

2. In order to justify correction of a military record, the applicant must show to the satisfaction of the Board or it must otherwise satisfactorily appear that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

____X___ ___X____ ___X_____ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.
