THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction to her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Overseas Service Ribbon (OSR) and the Army Achievement Medal (AAM).

2.  She states that she was stationed in Germany from May 2009 to December 2010.  She was awarded the AAM, but did not receive it until after she out-processed.

3.  She provides:

* Assignment orders for Germany, dated 30 April 2009
* DA Form 638 (Recommendation for Award) for the AAM, dated 8 November 2010
* Discharge orders, dated 9 November 2010
* DD Form 214

CONSIDERATION OF EVIDENCE:

1.  The applicant’s military record shows she enlisted in the Regular Army, in pay grade E-4, on 20 August 2008, for 4 years.  She completed training and was awarded military occupational specialty 25P (Microwave Systems Operator/Maintainer).  

2.  She served in Germany from on or about 29 May 2009 through on or about 1 December 2010.
3.  On 8 November 2010, she was recommended for award of the AAM for exceptional meritorious achievement from 28 May 2009 to 1 December 2010.  The award was approved by Permanent Orders Number 319-02 on 18 November 2010.

4.  She was honorably discharged on 11 December 2010, under the provisions of Army Regulation 635-600 (Enlisted Separations), paragraph 5-8, for Parenthood. She was credited with completion of 2 years, 3 months, 12 days of net active service and 1 year, 6 months, and 3 days of foreign service.

5.  Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) of her DD Form 214 lists the:

* National Defense Service Medal
* Global War on Terrorism Service Medal
* Army Service Ribbon

6.  Army Regulation 600-8-22 (Military Awards) states the Overseas Service Ribbon was established by the Secretary of the Army on 10 April 1981.  Effective 1 August 1981, all members of the Active Army, Army National Guard, and Army Reserve in an active Reserve status are eligible for the award for successful completion of overseas tours.

7.  Army Regulation 614-30 (Overseas Service), prescribes policies pertinent to overseas permanent change of station (PCS) moves, overseas tour lengths, overseas tour curtailments, time-on-station, eligibility for overseas service criteria, voluntary and involuntary overseas tour extension, the Overseas Tour Extension Incentive Program, and consecutive overseas tours.  Table D-1 (Criteria for overseas tour lengths) states the standard overseas tour is a combination of an accompanied 36-month tour or an unaccompanied 24-month tour.

DISCUSSION AND CONCLUSIONS:

1.  The evidence of record shows the applicant was awarded the AAM by permanent orders on 18 November 2010.  Therefore, she is entitled to a correction of her DD Form 214 to show this award.

2.  The evidence of record also shows she served in Germany from 29 May 2009 through 1 December 2010, a period of 1 year, 6 months, and 3 days.  As such, she did not complete a qualifying period of service for award of the OSR.  Therefore, she is not entitled to correction of her DD Form 214 to show this award.
3.  In view of the foregoing, her records should be corrected as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to Item 13 of the applicant's DD Form 214 the Army Achievement Medal.

2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends 
denial of so much of the application that pertains to award of the Overseas Service Ribbon and its addition to her DD Form 214.
