THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests her DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 17 December 2008 be corrected to show one award of the Meritorious Service Medal (MSM) instead of two awards of the MSM.

2.  The applicant states item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) of this DD Form 214 shows she has two awards of the MSM, which is incorrect.  She contends she only had one award of the MSM as of December 2008.

3.  The applicant provides a DA Form 638 (Recommendation for Award), DA Form 4980-12 (Meritorious Service Medal Certificate), and a copy of his DD Form 214 for the period ending 17 December 2008 in support of his application.

CONSIDERATION OF EVIDENCE:

1.  The applicant was ordered to active duty from the U.S. Army Reserve on 27 July 2007 in support of Operation Enduring Freedom.  She served in Iraq from 25 May 2008 to 16 November 2008.  On 17 December 2008, she was released from active duty.

2.  Item 13 of the applicant's DD Form 214 for the period ending 17 December 2008 shows the Iraq Campaign Medal, Defense Meritorious Service Medal, Meritorious Service Medal (2nd Award), Army Achievement Medal, Army Reserve Components Achievement Medal (5th Award), National Defense Service Medal (2nd Award), Global War on Terrorism Service Medal, Army Service Ribbon, Armed Forces Reserve Medal with "M" Device, and Military Outstanding Volunteer Service Medal as authorized awards.

3.  In support of her claim, the applicant provided an approved DA Form 638 showing Permanent Order Number 271-2, Headquarters, U.S. Army Forces Command, dated 6 September 2006, for the MSM for the period 11 October 2004 to 10 October 2006.  Item 8 (Previous Awards) of this form shows the Army Achievement Medal.  She also provided an award certificate for the MSM for the period 11 October 2004 to 10 October 2006 which shows Permanent Order Number 271-2.

4.  There are no orders for a second award of the MSM in the applicant's service personnel records.

5.  Item 9 (Awards, Decorations and Campaigns) of the applicant's DA Form 2-1 (Personnel Qualification Record) shows, among other awards, one award of the MSM.

6.  The applicant's service personnel records contain a DA Form 638, dated 14 March 2008, for the MSM with First Oak Leaf Cluster for the period 27 July 2007 to 17 May 2008.  Item 8 of this form shows, among other awards, one award of the MSM.  This form also shows the recommendation for the MSM was downgraded to award of the Army Commendation Medal.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's DD Form 214 for the period ending 17 December 2008 shows two awards of the MSM.  However, the applicant contends she only had one award of the MSM as of December 2008.  The preponderance of evidence also shows she had one award of the MSM.  Based on the applicant's request, it would be appropriate to correct this DD Form 214 to show one award of the MSM.

2.  The evidence of record shows the applicant was awarded the Army Commendation Medal.  Therefore, her DD Form 214 for the period ending 17 December 2008 should be corrected to show this award.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a.  deleting the entry "Meritorious Service Medal (2nd Award)" from item 13 of her DD Form 214 for the period ending 17 December 2008 and replacing it with the entry "Meritorious Service Medal" and

	b.  adding the Army Commendation Medal to item 13 of this DD Form 214.
