THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, correction to his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Army Achievement Medal (2nd Award).  

2.  The applicant states, in effect, that his DD Form 214 should reflect the Army Achievement Medal (2nd Award) that he received on 4 February 2009.  The DD Form 214 was completed before the award was issued.   

3.  In support of his application, the applicant provides copies of a 2008 and 2009 DA Form 638 (Recommendation for Award), his 2008 and 2009 Army Achievement Medal certificates, and his DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  The applicant’s military records show he enlisted in the Ohio Army National Guard (OHARNG), in pay grade E-2, on 24 January 2006.  

2.  The applicant submits a copy of an undated DA Form 638, showing he was recommended for award of the Army Achievement Medal for the period from 14 May 2006 to 15 April 2008, for outstanding achievement while assigned to Headquarters and Headquarters Company, 37th Infantry Brigade Combat Team, OHARNG.  The award was approved on 2 June 2008 and is currently shown on his DD Form 214. 

3.  The applicant also submits a copy of the resulting certificate, dated 2 June 2008, awarding him the Army Achievement Medal, for outstanding achievement in the performance of duty, from 14 May 2006 to 15 April 2008, by Permanent Order 153-01.

4.  The applicant was honorably separated from the OHARNG on 7 June 2008.  He was appointed in the United States Army Reserve, Military Intelligence Branch, as a second lieutenant, on 8 June 2008.  

5.  The applicant was ordered to active duty for training for attendance to the Military Intelligence Basic Officer Leadership Course.  He entered active duty on 3 August 2008.  He exceeded course standards and completed the course on 4 February 2009.

6.  The applicant further submits a copy of a DA Form 638, dated 7 January 2009, showing he was recommended for award of the Army Achievement Medal for the period from 29 September 2008 to 4 February 2009, for exceptionally meritorious achievement for successfully completing the Van Deman Program during the Military Intelligence Basic Officer Leadership Course.  The award of the Army Achievement Medal with one oak leaf cluster was approved on 23 January 2009.

7.  The applicant also submits a copy of the resulting certificate, dated 26 January 2009, awarding him the Army Achievement Medal, for exceptionally meritorious achievement, from 29 September 2008 to 4 February 2009, by Permanent Orders 026-001.

8.  The applicant was honorably released from active duty training on 4 February 2009 and he was transferred to his Reserve unit.

9.  Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized), of the applicant's DD Form 214, lists the following awards:  the Army Achievement Medal, the National Defense Service Medal, the Army Service Ribbon, and the Parachutist Badge.  The Army Achievement Medal (2nd Award) is not shown.

DISCUSSION AND CONCLUSIONS:

1.  The evidence shows the applicant, while serving as a member of the OHARNG was awarded the Army Achievement Medal for outstanding achievement in the performance of duty, from 14 May 2006 to 15 April 2008.  The award was approved and awarded by Permanent Order 153-01 on 2 June 2008.
2.  The applicant also shows the applicant was awarded the Army Achievement Medal for exceptionally meritorious achievement while he served on active duty for training to attend the Military Intelligence Basic Officer Leadership Course.  The award was approved on 23 January 2009 and was awarded by Permanent Order 026-001.  He completed the course on 4 February 2009 and was released from active duty for training on the same day.  

3.  The Army Achievement Medal (2nd Award) was not included on his DD Form 214.  The applicant provided a copy of his DA Forms 638 and certificates showing he was awarded this Army Achievement Medal.  Therefore, he is entitled to a correction of his DD Form 214 to show the Army Achievement Medal (2nd Award).

4.  In view of the foregoing, the applicant’s records should be corrected as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing the applicant was awarded the Army Achievement Medal (2nd Award) and providing him a document that includes this change.
