THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that 801st Brigade Support Battalion [BSB], 
4th Brigade Combat Team [BCT] (Currahee), 101st Airborne Division [ABN DIV] (AASLT) [Air Assault], Forward Operating Base [FOB] Sharana, Afghanistan Permanent Orders 165-12, dated 13 June 2008, be removed from her official military personnel file (OMPF) on file in the integrated Personnel Electronic Records Management System (iPERMS).

2.  The applicant states the period of service in the orders is incorrect, the orders have been revoked, and a new set of orders with the correct dates of service has been issued.

3.  The applicant provides, in support of her application, copies of two orders awarding her the Army Good Conduct Medal and one order revoking the order dated 13 June 2008. 

CONSIDERATION OF EVIDENCE:

1.  The applicant's military personnel record shows she initially enlisted in the Regular Army on 20 August 2003 for a period of 4 years.  She successfully completed basic combat and advanced individual training and was awarded the military occupational specialty of 68W (Health Care Specialist.  She reenlisted on 17 May 2005 for a period of 6 years and she was promoted to staff sergeant effective 1 February 2007.


2.  Permanent Orders 165-12, dated 13 June 2008, awarded the applicant the Army Good Conduct Medal (2nd Award) for the period of service from 21 August 2005 to 20 August 2008.  

3.  801st BSB, 4th BCT (Currahee), 101st ABN DIV (ASSLT), FOB Sharana Permanent Orders 191-018, dated 9 July 2008, awarded the applicant the Army Good Conduct Medal (2nd Award) for the period of service from 20 August 2005 to 19 August 2008.  

4.  801st BSB, 4th BCT (Currahee), 101st ABN DIV (AASLT), FOB Sharana Permanent Orders 280-001, dated 6 October 2008, revoked Permanent Orders 165-12, dated 13 June 2008.

5.  A review of the applicant's OMPF on iPERMS showed that Permanent Orders 165-12, dated 13 June 2008, and Permanent Orders 191-018, dated 9 July 2008 are both currently entered in the applicant's OMPF in the iPERMS.  However, Permanent Orders 280-001, dated 6 October 2008, were not filed in her OMPF in iPERMS.

6.  Army Regulation 600-8-104 (Military Personnel Information Management/ Records), provides in Table 2-1 (Composition of the OMPF) provides that award orders are filed in the Commendatory and Disciplinary portion of the OMPF.  This regulation also provides that once filed such documents become a permanent part of the OMPF and may only be removed by one of several agencies, one of which is the Army Board for Correction of Military Records (ABCMR).

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that the erroneous orders for the award of the Army Good Conduct Medal (2nd Award) should be removed from her OMPF in the iPERMS.

2.  The evidence is clear that, due to an administrative error, the 801st BSB, 
4th BCT (Currahee), 101st ABN DIV (AASLT), FOB Sharana issued two Permanent Orders, 165-12 and 191-018, awarding the applicant the Army Good Conduct Medal (2nd Award).  However, each set of orders contained a different period of service for the award.

3.  Upon discovery of the error, the 801st BSB, 4th BCT (Currahee), 101st ABN DIV (Assault), FOB Sharana issued Permanent Orders 280-001, dated 6 October 2008, revoking Permanent Orders 165-12, dated 13 June 2008.  

4.  In view of the above, Permanent Orders 165-12, dated 13 June 2008, and Permanent Orders 280-001, dated 6 October 2008, hold no historical value in documenting the applicant's military career.  These two documents only show administrative error on the part of the 801st BSB, 4th BCT (Currahee), 101st ABN DIV (ASSLT), FOB Sharana.

5.  Therefore, it is appropriate to remove Permanent Orders 165-12, dated
13 June 2008, from the applicant's OMPF in iPERMS.  In addition, it would be appropriate to ensure that Permanent Orders 280-001, dated 6 October 2008, is not filed in the applicant's OMPF.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by removing 801st BSB, 4th BCT (Currahee), 101st ABN DIV (ASSLT), FOB Sharana Permanent Orders 165-12, dated 13 June 2008, and any subsequent revocations and/or amendments to these orders from the applicant's OMPF in iPERMS.
