THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of item 12f (Foreign Service) on her DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 10 September 2008 to show she served 5 months and 3 days of foreign service from her first mobilization from 29 December 2002 through 1 June 2003.
2. The applicant also requests correction of item 11 (Primary Specialty) on her DD Form 214 for the period ending 10 September 2008 to show she served in primary specialty 66P (Family Nurse Practitioner) for 13 years and 11 months and served in specialty 66H (Medical Surgical Nurse) for 8 years and 10 months.
3. The applicant states, in effect, that her previous DD Form 214 for the period ending 24 June 2003 and award documents show the area of concentration (AOC), specialty, and additional skill identifier (ASI) awarded to her.
4. The applicant provides a copy of her DD Form 214 for the period ending 24 June 2003; her DD Form 214 for the period ending 10 September 2008; a memorandum, subject: Commissioned Officer Specialty Skill Identifier and Additional Skill Identifier, dated 14 November 1995; and a memorandum,
subject: Commissioned Officer Skill Identifier, dated 13 October 2001, in support of her application.
CONSIDERATION OF EVIDENCE:
1. The applicant was appointed as a second lieutenant in the Missouri Army National Guard on 12 November 1985.
2. Her DA Form 1059 (Service School Academic Evaluation Report), dated 19 July 1991, shows she completed the Army Medical Department (AMEDD) Officer Advanced Course, Phase III on 19 July 1991. This report shows her specialty as 66H.
3. In a 14 November 1995 memorandum, the Missouri Army National Guard notified the applicant that her State Military Personnel File had been reviewed and she was awarded ASI 8E (Nurse Practitioner).
4. In a 13 October 2001 memorandum, the Missouri Army National Guard notified the applicant that her State Military Personnel File had been reviewed and she was awarded ASI 8E effective 13 October 2001.
5. Headquarters, Missouri National Guard, Office of The Adjutant General, Jefferson City, Missouri, Orders 345-069, dated 11 December 2002, show the applicant was ordered to active duty on 12 December 2002 in support of Operation Enduring Freedom. These orders show her primary specialty and ASI as 66H, 8E, respectively.
6. She was released from active duty on 24 June 2003. Her DD Form 214 for the period ending 24 June 2003 shows she served in Kuwait from 29 December 2002 through 1 June 2003. Item 12f on her DD Form 214 for the period ending 24 June 2003 shows she served 5 months and 3 days of foreign service.
7. Item 11 on her DD Form 214 for the period ending 24 June 2003 shows the entry "66H 8E MED-SURGICAL NURSE--17 YRS-7 MOS//NOTHING FOLLOWS."
8. The applicant was promoted to the rank of lieutenant colonel on 13 May 2005 and was granted Federal Recognition effective 13 May 2005.
9. Headquarters, Missouri Army National Guard, Joint Force Headquarters, Orders 123-329, dated 3 May 2005, shows the applicant was reassigned from duty position Head Nurse (66H) to duty position Nurse Practitioner (66H) effective 1 January 2005.
10. In a 19 June 2006 memorandum, the Missouri National Guard notified the applicant that her Military Personnel File had been reviewed and she was awarded specialty 61P (Psychiatrist) effective 19 June 2006. This memorandum indicates that her Primary Specialty Skill Identifier (PSSI) of 62H was withdrawn. This memorandum appears to have been issued in error as there is no evidence the applicant was ever Medical Corps.
11. In a 23 August 2006 memorandum, the Missouri National Guard notified the applicant that her Military Personnel File had been reviewed and she was awarded specialty 66P effective 23 August 2006.
12. The applicant was ordered to active duty on 1 September 2006 in support of Operation Enduring Freedom.
13. The applicant was given an annual Officer Evaluation Report for the period ending 9 May 2008 which shows her specialty as 66P and was assigned for duty at the U.S. Army Human Resources Command, St. Louis, MO (HRC-STL).
14. She was released from active duty on 10 September 2008. Item 12f of her DD Form 214 for the period ending 10 September 2008 does not show any foreign service. Item 18 (Remarks) of this discharge document shows she was ordered to active duty in support of Operation Enduring Freedom but not that she served overseas during this period of mobilization.
15. Item 11 on her DD Form 214 for the period ending 10 September 2008 shows the entry "66P FAMILY NURSE PRACTITI - 2 YRS - 0 MOS//NOTHING FOLLOWS."
16. In an 8 April 2009 electronic mail message, the Defense Finance and Accounting Service (DFAS) informed a staff member of the Case Management Division that they were unable to verify the applicant served in a combat zone or received hostile fire pay (HFP)/imminent danger pay (IDP) during the period September 2006 to September 2008.
17. Army Regulation 635-5 (Separation Documents) governs the preparation of the DD Form 214. It states that the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge. In pertinent part, it directs that the titles of all MOS or AOC served for at least one year and the number of years and months served will be entered in item 11. For time determination, 16 days or more count as a month. For commissioned officers, also specify the AOC consisting of 2 numerical digits and 1 letter.
18. Army Regulation 635-5 directs that foreign service performed during the period covered by the DD Form 214 will be entered in item 12f.
DISCUSSION AND CONCLUSIONS:
1. The applicant was ordered to active duty from 12 December 2002 through 24 June 2003 and served in support of Operation Enduring Freedom and Operation Iraqi Freedom during this period. She was issued a DD Form 214 for the period ending 24 June 2003 which properly reflects 5 months and 3 days of foreign service in item 12f for her service in Kuwait from 29 December 2002 to 1 June 2003.
2. The applicant was ordered to active duty from 1 September 2006 to 10 September 2008 in support of Operation Enduring Freedom. However, there is no evidence that she deployed overseas during her second mobilization.
3. Although the applicant requests correction of her DD Form 214 for the period ending 10 September 2008 to show her foreign service from her first mobilization (29 December 2002 through 1 June 2003), the governing regulation directs that only foreign completed during the period covered by the DD Form 214 should be entered in item 12f. Therefore, there is no basis for amending her DD Form 214 for the period ending 10 September 2008 to show she served 5 months and 3 days of foreign service.
4. The applicant states, in effect, that her DD Form 214 for the period ending 24 June 2003 and award documents show AOC, specialty, and ASI awarded to her.
5. The evidence of record shows the applicant was not awarded specialty 66P until 23 August 2006. She served in specialty 66P while on active duty from 1 September 2006 to 10 September 2008. Therefore, her DD Form 214 for the period ending 10 September 2008 properly reflects that she served in specialty 66P for 2 years.
6. There is no evidence of record which shows the applicant held specialty 66H during her last mobilization. Therefore, there is no basis for amending item 11 of her DD Form 214 for the period ending 10 September 2008 to reflect she served in specialty 66H for 8 years and 10 months.
