Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests entitlement to Registered Nurse Incentive Special Pay (RNISP) for the period 3 January to 30 September 2013. 2. The applicant states she did not receive RNISP during the period 3 January to 30 September 2013 while she was serving on active duty. She is a Nurse Care Manager for the Warrior Transition Battalion (WTB), Fort Stewart, GA. As of 1 October 2013, RNISP is no longer authorized for her area of concentration (AOC), 66H (Medical/Surgical Nurse). 3. The applicant provides orders. CONSIDERATION OF EVIDENCE: 1. Having had prior enlisted service, the applicant was appointed as a second lieutenant, Army Nurse Corps, U.S. Army Reserve (USAR), in AOC 66H, and she executed an oath of office on 28 September 2009. She was promoted to Captain on 27 June 2013. 2. Orders A-11-220618, dated 16 November 2012, issued by the U.S. Army Human Resources Command, ordered her to active duty as a member of the USAR for operational support to Fort Stewart, GA, for a period of 365 days, with a report date of 3 January 2013. 3. She entered active duty on 3 January 2013 and was assigned in AOC 66H as a Nurse Case Manager, WTB, Fort Stewart. 4. Her records contain a DA Form 67-9 (Officer Evaluation Report) she received for her duties as a Nurse Care Manager, WTB, Fort Stewart. It is an annual report covering 10 months of rated time for the period 23 October 2012 through 22 October 2013. She received an "outstanding performance, must promote" rating from her rater and a "best qualified" rating from her senior rater. 5. In the processing of this case, an advisory opinion was received on 22 December 2014 from the Office of The Surgeon General (OTSG). The advisory recommended denial of the applicant's request and stated: a. Paragraph 6, All Army Activities (ALARACT) Message 365/2010, indicates basic eligibility for RNSIP includes fully qualified in specialty; credentialed to the basic standards of the specialty in accordance with Army Regulation 40-66 (Medical Record Administration and Healthcare) without prejudicial restriction of clinical privileges; possession of a full, unrestricted license or wavier; and performs the duties of specialty RN for sufficient time during the contract period to allow for the full maintenance of professional skills in that specialty. Full qualification as a Nurse Care Manager requires the AOC 66H and graduation from the pertinent Army Nurse Residency Program, or possession of a graduate degree, plus board certification. b. The applicant did not indicate or provide documentation to support the training and board certification requirements as a Nurse Care Manager. Verification channels could not validate her full qualification as a Nurse Care Manager. She is not eligible for the RNISP without verification of supporting documentation as discussed in paragraph 5a above. 6. The applicant was provided the advisory opinion for her information and response. On 8 January 2015, the applicant responded and provided documentation to include her RN license and proof of graduation from the Nurse Case Management Course. 7. On 23 February 2015, the OTSG sent an updated advisory opinion. The advisory official recommended approval of the applicant's request and stated: a. The applicant supplied supplemental documentation to support training at the Academy of Health Sciences, Fort Sam Houston, TX, in Nurse Care Management. The OTSG verified through with the Commission for Case Management Certification (CCMC) that she is board certified through 31 May 2019. b. Specialty RNs who meet the basic eligibility, including the training/degree and board certification, are authorized the RNISP at $5,000 per year, prorated on a monthly basis of $416.66 for actual time mobilized. c. The applicant met the requirements and was eligible for the RNISP for the 9-month period 3 January to 30 September 2013. DISCUSSION AND CONCLUSIONS: As verified by OTSG, the applicant was eligible for the RNISP in the amount of $416.66 per month while mobilized in AOC 66H and assigned as a Nurse Care Manager, WTB, Fort Stewart, for the period 3 January to 30 September 2013. It is not known why an RNISP contract was not initiated for her upon her arrival at Fort Stewart, but is clear that she met the criteria for the specialty pay. Therefore, it would be appropriate to correct her records as recommended below.
