The Board considered the following evidence:

Exhibit A - Application for correction of military records.

Exhibit B - Military Personnel Records (including advisory opinion, if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his Certificate of Release or Discharge from Active Duty (DD Form 214) to show three awards of the Army Commendation Medal.

2. The applicant states, in effect, that he was awarded three Army Commendation Medals but all of them are not listed on his DD Form 214.

3. The applicant provides copies of his DD Form 214 and two certificates showing award of the Army Commendation Medal.

CONSIDERATION OF EVIDENCE:

1. On 22 August 2000, the applicant enlisted in the Regular Army. He completed his initial training and was awarded military occupational specialty 92Y2O (Unit Supply Specialist).

2. On 21 October 2003, the applicant was assigned for duty in the Federal Republic of Germany. He was returned to the United States on 20 January 2006, for assignment at Fort Leonard Wood, Missouri.

3. On 8 May 2007, the applicant was honorably released from active duty and transferred to the 49th Military Police Brigade, Fairfield, California. He had attained the rank of sergeant (pay grade E-5), and had completed 6 years,
8 months, and 17 days of creditable active service.

4. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 lists two awards of the Army Commendation Medal, Army Achievement Medal, two awards of the Army Good Conduct Medal, National Defense Service Medal, Global War on Terrorism Service Medal, Global War of Terrorism Expeditionary Medal, Army Service Ribbon, Overseas Service Ribbon, and the Expert Marksmanship Qualification Badge with Rifle Bar. It does not show a third award of the Army Commendation Medal.

5. Section VIII (Awards and Decorations) of the applicant's Enlisted Record Brief, dated 5 January 2007, shows that he was awarded only one Army Commendation Medal.

6. The applicant provided two certificates for award of the Army Commendation Medal. Each certificate indicates an award order number and date, and provides the following information:

	a. Department of the Army, The Army Commendation Medal for the period from 17 November 2005 to 8 May 2007, for meritorious service as a supply sergeant with the 187th Infantry Brigade, Fort Leonard Wood, Missouri; and

	b. Department of the Army, The Army Commendation Medal for the period from 18 October 2003 to 18 October 2005, for meritorious service as a supply sergeant with the 1st Armored Division Artillery.

DISCUSSION AND CONCLUSIONS:

1. The available evidence clearly shows that the applicant was awarded two Army Commendation Medals, which are currently recorded on his DD Form 214. However, the available evidence does not show that he received a third award of the Army Commendation Medal. Furthermore, the applicant has not provided copies of the orders authorizing these awards. The certificates, by themselves, are insufficient as a basis to grant the requested corrections.

2. Should the applicant have, or be able to obtain, copies of the orders awarding him these medals, then he may resubmit an application requesting reconsideration.

3. In view of the above, the applicant's request should be denied.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

_ DED __ __MKP__ __LCB _ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.
