THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Valorous Unit Award and Meritorious Unit Commendation.

2.  The applicant states the requested awards were not entered on his DD Form 214 at the time of his discharge.

3.  The applicant provides:

* Permanent Orders 263-10, U.S. Army Human Resources Command (HRC), dated 19 September 2008
* memorandum, Company A, 795th Military Police (MP) Battalion, Fort Leonard Wood, MO, dated 30 September 2008
* Permanent Orders 233-24, HRC, dated 21 August 2009

CONSIDERATION OF EVIDENCE:

1.  The applicant's record shows he enlisted in the Regular Army on 25 August 2005.  He completed training and was awarded military occupational specialty 31B (MP).


2.  His records show he was deployed to Iraq with the 127th MP Company during the period 4 November 2006 through 24 January 2008.

3.  On 29 January 2009, he was discharged with an under honorable conditions (general) characterization of service.  His DD Form 214 shows he completed 3 years, 5 months, and 5 days of net active service during his period of enlistment.

4.  Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) of his DD Form 214 shows he was awarded the:

* Iraq Campaign Medal
* Army Commendation Medal
* Army Good Conduct Medal
* National Defense Service Medal
* Global War on Terrorism Service Medal
* Army Service Ribbon
* Overseas Service Ribbon (2nd Award)
* Driver and Mechanic Badge with Mechanic Bar

5.  Item 18 (Remarks) of his DD Form 214 contains the entry "SERVICE IN IRAQ – OPERATION IRAQI FREEDOM 20061104-20080124."

6.  Permanent Orders 263-10, HRC, dated 19 September 2008, awarded the Valorous Unit Award to Detachment, 127th MP Company, for the period 1 May 2007 through 5 September 2007.

7.  A memorandum from the first sergeant of Company A, 795th MP Battalion, Fort Leonard Wood, MO, dated 30 September 2008, states the applicant was a member of Detachment, 127th MP Company.

8.  Permanent Orders 233-24, HRC, dated 21 August 2009, awarded the Meritorious Unit Commendation to the 127th MP Company for the period 16 November 2006 through 29 October 2007.

9.  A review of the applicant's records indicates he is entitled to additional awards which are not shown on his DD Form 214.

10.  Military Personnel Message Number 10-078, dated 16 March 2010, designated six campaigns for the Iraq Campaign Medal:  Liberation of Iraq from 

19 March 2003 through 1 May 2003, Transition of Iraq from 2 May 2003 through 28 June 2004, Iraqi Governance from 29 June 2004 through 15 December 2005, National Resolution from 16 December 2005 through 9 January 2007, Iraqi Surge from 10 January 2007 through 31 December 2008, and Iraqi Sovereignty from 1 January 2009 to a date to be determined.  Furthermore, Army Regulation 600-8-22 (Military Awards) states a bronze service star will be awarded for wear on the Iraq Campaign Medal for participation in each credited campaign.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's record shows he was deployed to Iraq from 4 November 2006 through 24 January 2008.

2.  Permanent orders awarded his unit the Valorous Unit Award and Meritorious Unit Commendation which are not shown on his DD Form 214.  Therefore, he is entitled to correction of his DD Form 214 to show these unit awards.

3.  His record shows he participated in the National Resolution and Iraqi Surge campaigns based on his deployment to Iraq; therefore, he is entitled to correction of his DD Form 214 to show two bronze service stars for wear on his already-awarded Iraq Campaign Medal.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

* deleting the Iraq Campaign Medal from item 13 of his DD Form 214
* 
adding the Valorous Unit Award, the Meritorious Unit Commendation, and Iraq Campaign Medal with two bronze service stars to item 13 of his DD Form 214
