THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show he was awarded two Army Good Conduct Medals and that his Military Occupational Specialty (MOS) number be changed to 31B2O.

2.  The applicant states on his DD Form 149 (Application for Correction of Military Records), item 6 (I believe the Record to be in Error or Unjust for the Following Reasons):  “Identifier states MOS should be 31B20; Earned both Good Conduct Medals.”  He states in item 9 (In Support of This Application, I Submit as Evidence the Following Attached Documents):  “L8AZR3P071-(T)B, Traffic Management & Collision Investigation Certificate.”  However, nothing is attached.

3.  The applicant submitted no supporting documents.
 
CONSIDERATION OF EVIDENCE:

1.  The applicant served in the Regular Army from August 2007 to October 2014.  

2.  He completed training with the 795th Military Police (MP) Battalion at Fort Leonard Wood, Missouri and then served as an MP at Fort Stewart, Georgia.  

3.  There are no available orders awarding him an MOS but transfer orders to his next permanent duty station show his MOS as 31B1O (MP).  He attended several MP schools including L8AZR3P071-(T)B, Traffic Management & Collision Investigation which is mentioned without explanation in item 9 as supporting evidence for his application.  This course qualified him for the special qualification identifier (SQI) of Q9.  His final assignment was with  the 13th MP Detachment, Schofield Barracks, Hawaii as Traffic Management and Collision Investigator in MOS 31B2O from October 2012 to October 2014.

4.  8th MP Brigade Permanent Orders number 246-001 dated 3 September 2014 awarded him the Army Commendation Medal (2nd Award).

5.  13th MP Detachment Permanent Orders 213-0002 dated 1 August 2013 awarded him the Army Good Conduct Medal (2nd Award) for the period 22 August 2010 to 21 August 2013.

6.  The applicant was honorably separated as a specialist/pay grade E-4 on 13 October 2014 due to the completion of required service.  His DD Form 214 shows the MOS entry in item 11 (Primary Specialty) as, “31B1O Military Police – 6 yrs [years] 9 mos [months].”  

7.  His awards are listed as the Afghanistan Campaign Medal with two bronze service stars, Army Commendation Medal, Army Achievement Medal (2nd Award) National Defense Service Medal, Global War on Terrorism Service Medal, Noncommissioned Officer Professional Development Ribbon, Army Service Ribbon, Overseas Service Ribbon (2nd Award), NATO Medal, Driver and Mechanic Badge-Mechanic, Expert Marksmanship Qualification Badge with Carbine and Rifle Bars. 

8.  Army Regulation 611-201 (Enlisted Career Management Fields and Military Occupational Specialties) prescribes the authorized MOS codes (MOSC) for enlisted Soldiers.  It also shows:

   a.  The MOS skill level (i.e., the 4th character in the MOSC for an enlisted Soldier, is as follows:

   0				personnel undergoing training for first MOS
   1 				E-4 and below (helper or entry-level)
   2				E-5 (fully qualified/under general supervision)
   3				E-6 (advanced journeyman/minimum supervision)
   4				E-7 (first-line supervisor/detailed knowledge)
   5				E-8 (managerial-type supervisor/broad knowledge)

   b.  The 5th character will be a letter or number. It shows an SQI common to a number of positions and MOS.  The letter O will always be inserted as the fifth character when a position does not require special qualifications or an individual is not qualified for award of an SQI.  SQI "Q9" is identified as a Traffic Accident Investigator 

9.  Army Regulation 635-8 (Personnel Separations-Separation Processing and Documents) sets forth the instructions for preparing an individual’s DD Form 214.
The instructions for block 11 (Primary Specialty) state, in pertinent part:

For an enlisted Soldier, specify the first five characters of the military occupational specialty code (MOSC), which includes three characters of the MOS, the fourth character of skill and grade level in the MOS, and the fifth character of a special qualification identifier, if applicable.  Enter “O” when not applicable. 

DISCUSSION AND CONCLUSIONS:

1.  The applicant requests his DD Form 214 be corrected to show two awards of the Army Good Conduct Medal, in effect the second award of the Army Commendation Medal, and his MOS changed to 31B2O.

2.  The applicant was awarded two awards each of the Army Good Conduct Medal and the Army Commendation Medal.  These awards were inadvertently omitted from his DD Form 214.  Therefore, there is sufficient evidence to correct his discharge document to show these awards.

3.  Although he served in duty MOS 31B2O, there are no available orders awarding him an MOS of 31B20 or promoting him to sergeant (E-5).  As a specialist the proper fourth character of the MOS shown on his DD Form 214 should be a “1” as it is currently shown.  However, he did qualify for the SQI "Q9" and worked in that specialty as a Traffic Accident Investigator for 2 years.  Therefore, based on the evidence of record it would be appropriate to correct his record.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by correcting his DD Form 214 in:

	a.  Item 11 delete current entry and enter, "31B1O Military Police - 4 years and 8 months//31B1Q9 Traffic Accident Investigator - 2 years 0 months//Nothing Follows"; and 

	b.  item 18 (Decorations, Medals, etc.) delete the Army Commendation Medal and add Army Commendation Medal (2nd Award) and Army Good Conduct Medal (2nd Award).

2.  The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains changing the fourth character of the MOS shown on the DD Form 214 to a “2”.
