IN THE CASE OF:
BOARD DATE: 22 March 2007

The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion, if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) with the period ending 24 October 2005 to show she completed the Primary Leadership Development Course (PLDC).
2. The applicant states, in effect, that her DA Form 1059 (Service School Academic Evaluation Report) with the period ending 1 November 2003 was issued after the course was completed.
3. The applicant provides her DD Form 214 and a DD Form 1059.
CONSIDERATION OF EVIDENCE:
1. The applicant has served in support of Operation Iraqi Freedom (OIF).
2. The applicant enlisted in the U.S. Army Reserve on 23 August 2001 and successfully completed basic training and advanced individual training. She was awarded military occupational specialty 71L (Administrative Specialist).
3. The applicant submitted a DA Form 1059, dated 1 November 2003, that shows she completed the Reserve Component PLDC at Fort Dix, New Jersey on 1 November 2003.
4. The applicant was ordered to active duty on 3 October 2004 and she was released from active duty on 24 October 2005. Item 14 of her DD Form 214 (Military Education) shows the entry "COMBAT LIFESAVER, 1 WEEKS, OCT 2004//NOTHING FOLLOWS."
5. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. It states for item 14 (Military Education), list in-service training courses successfully completed during the period of service covered by the DD Form 214.
DISCUSSION AND CONCLUSIONS:
1. Evidence of record shows that the applicant completed the Reserve Component PLDC in 2003 at Fort Dix, New Jersey. She was ordered to active duty on 3 October 2004 and was released from active duty on 24 October 2005. In accordance with Army Regulation 635-5, PLDC was not completed during the period of service covered by the DD Form 214; therefore, there is no basis for correcting the applicant's DD Form 214 to show this course.

The applicant states that: a. she has two DA forms 1059 showing she completed Phase I of BNCOC; b. she has completed the Warrior Leadership Course in 2006 and would like to have the DA Form 1059 for PLDC removed; c. she was awarded a certificate of achievement that is showing the wrong year; and d. she only needs one DD Form 214 in her OMPF. The applicant's records also show that she was released from active duty on 23 October 1999 in accordance with chapter 4 of Army Regulation 635-200...

The applicant requests the removal of a DA Form 1059 (Service School Academic Evaluation Report (AER)) ending 22 January 2003 from her official military personnel file (OMPF). The AER in question is properly filed in the applicant's OMPF in accordance with the applicable regulation to reflect that she attended the course and was released from the course for medical reasons. The Army has an interest in maintaining records of Soldiers who attend formal courses of instruction and the...
ARMY | BCMR | CY2008 | 20080014443
There is no indication or evidence in the applicant's records that she was enrolled in or completed Phase II of MOS 54B BNCOC as stipulated in her promotion orders. The evidence of record further shows the applicant was conditionally promoted to SSG/E-6 on 30 June 1998 in MOS 54B contingent upon her successful completion of BNCOC. With respect to the applicant's contention that she should be considered for promotion to SFC/E-7, there is no evidence that the applicant met grade and/or NCOES...

The applicant requests removal of a negative DA Form 1059 (Service School Academic Evaluation Report) from her Official Military Personnel File (OMPF). Table 2-1 of AR 600-8-104 states that the DA Form 1059 will be filed in the performance section of the OMPF. This DA Form 1059, dated 1 August 2001, is also filed in her P fiche.

John Heck | |Member | The Board considered the following evidence: Exhibit A - Application for correction of military records. The applicant requests, in effect, the removal of an Academic Evaluation Report (AER) (DA Form 1059) dated 11 March 1997 from her Official Military Personnel File (OMPF). Therefore, absent evidence to show that the contested AER is improperly filed in her OMPF, there appears to be no basis to grant her request.

The applicant requests that her uncharacterized discharge be changed to an honorable discharge. The applicant was released from active duty training on 9 June 1989 with an uncharacterized discharge. There is no evidence which indicates the applicant applied to Army Discharge Review Board within its 15-year statute of limitations.
ARMY | BCMR | CY2001 | 2001062199C070421
The applicant requests that her Certificate of Release or Discharge from Active Duty, DD Form 214, be amended to add the second award of the Army Good Conduct Medal, the Army Achievement Medal (AAM), the Army Commendation Medal (ARCOM), the National Defense Service Medal (NDSM), and the Noncommissioned Officers Professional Development Ribbon (NCOPDR) in item 13 and the 1998 Mental Health Specialist course, the 4 week 1999 Primary Leadership Development Course (PLDC), and Additional Skill...

This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. DISCUSSION AND CONCLUSIONS: The evidence of record supports the applicant's request for correction of her DD Form 214 to show she attended PLDC. As a result, the Board recommends that all Department of the Army records of the individual...
ARMY | BCMR | CY2005 | 20050006231C070206
The applicant requests, in effect, that her DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to include all her service time. Item 12 (Record of Service), subparagraph d. (Total Prior Active Service), of the applicant's DD Form 214, shows the entry: 0000 years / 02 months / 12 days.
