The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, promotion consideration for chief
warrant officer three (CW3) under the 2002 criteria.
2. The applicant states that his date of rank for CW2 was erroneously
entered in the Soldier Management System database at the Human Resources
Command (HRC) – St. Louis, Missouri, as 1 June 1999. His correct date of
rank was 1 June 1997. He should have been boarded under the 2002 criteria
and not under the 2004 criteria. Due to this error he was not boarded nor
promoted with his peers.
3. The applicant provides copies of his CW2 and CW3 Promotion as a Reserve
Commissioned Warrant Officer of the Army memorandums and electronic
correspondence from a warrant officer career manager, HRC – St. Louis.
CONSIDERATION OF EVIDENCE:
1. The applicant's military records show that while serving as a member of
the United States Army Reserve he was promoted to CW2 effective 1 June
1997.
2. He was considered and selected for promotion to CW3 by the 2004 Reserve
Components Selection Board that convened on 13 April and recessed on
23 April 2004.
3. He was issued a promotion memorandum, dated 24 March 2005, indicating
his promotion effective date and date for rank for CW3 as 1 June 2003.
4. Based upon review of the applicant’s records by the Office of
Promotions, Reserve Components, HRC – St. Louis, Missouri, it was
determined the applicant was erroneously not considered by the 2002 Reserve
Components Selection Board and is eligible for consideration for promotion
to CW3 under the 2002 criteria as an omit.
5. Current promotion policy specifies that promotion consideration/
reconsideration by a special selection board (SSB) may only be based on
erroneous non-consideration or material error that existed in the record at
the time of consideration.
DISCUSSION AND CONCLUSIONS:
1. The applicant’s records were erroneously not considered for promotion
to CW3 under the 2002 criteria and should now be submitted for appropriate
SSB consideration for this purpose.
2. In view of the foregoing findings and conclusions, it would be
appropriate to correct the applicant’s records as recommended below.

BOARD DETERMINATION/RECOMMENDATION:
1. The Board determined that the evidence presented was sufficient to
warrant a recommendation for relief. As a result, the Board recommends
that all Department of the Army records of the individual concerned be
corrected by submitting his records to a duly constituted SSB for promotion
consideration for CW3 under the 2002 criteria.
2. That if selected, his records be further corrected by showing he was
promoted to CW3 on his date of eligibility, as determined by appropriate
Departmental officials, using the 2002 criteria, provided he was otherwise
qualified and met all other prerequisites for promotion.
3. That if not selected, the applicant be so notified.
