The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his records to show the correct
dates for his awards of the 3rd and 4th Army Good Conduct Medal (AGCM) and
that Permanent Order Number 318-03 be removed from his records.
2. The applicant states, in effect, that the dates for his 3rd and 4th
award of the AGCM should be switched. The applicant further states that
after careful review, the only changes required are removal of Permanent
Order 318-03 and adding Permanent Order 294-01.
3. The applicant provides:
a. A self-authored statement.
b. Permanent Order Number 294-01, 205th Military Intelligence
Battalion (Operations), 500th Military Intelligence Brigade, Fort Shafter,
Hawaii, dated
20 October 2004.
c. Permanent Order Number 318-03, Installation Troop Command,
Military Personnel Department, United States Army Garrison, Fort Shafter,
Hawaii, dated 14 November 2003.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the Regular Army on 12 May 1988 for a period
of
4 years. He has served continuously on active duty and is currently
serving on assignment in Korea.
2. Evidence of record shows Permanent Orders Number 087-610, A Detachment,
509th Personnel Service Battalion, dated 28 March 1997. These orders show
the applicant was awarded the AGCM (3rd Award) for the period
13 May 1994 through 12 May 1997.
3. The applicant’s records contain Permanent Orders 276-165, 5th Personnel
Services Battalion, Fort Polk, Louisiana, dated 3 October 2000. These
orders show the applicant was awarded the AGCM (4th Award) for the period
12 May 1997 through 11 May 2000. (The 12 May 1997 date overlaps the
previous award of the AGCM and should have been dated 13 May 1997).
4. The applicant’s records contain Permanent Order 318-03, Installation
Troop Command, Military Personnel Department, United States Army Garrison,
Fort Shafter, Hawaii, dated 14 November 2003. These orders show the
applicant was awarded the AGCM (3rd Award) for the period 13 May 2000
through 12 May 2003. This is a duplicate award of the AGCM (3rd Award) as
the applicant was previously awarded the AGCM (3rd Award) and should be
revoked.
5. The applicant provided a copy of Permanent Order 294-01, 205th Military
Intelligence Battalion (Operations), 500 Military Intelligence Brigade,
Fort Shafter, Hawaii, dated 20 October 2004. These orders show the
applicant was awarded the AGCM (5th Award) for the period 13 May 2000
through 12 May 2003.
This award is given for the same period as shown in Permanent Order 318-03,
dated 14 November 2003 which awarded the applicant the AGCM (3rd Award).
6. The applicant provided a self-authored statement in which he stated
that after carefully reviewing his AGCM awards, that Permanent Order 294-01
should be added and Permanent Order Number 318-03 should removed. He
further stated that his AGCM (3rd Award) dates should be from 1995 to 1997.
7. Army Regulation 600-8-22 (Military Awards) states the AGCM is awarded
to individuals who distinguish themselves by their conduct, efficiency and
fidelity during a qualifying period of active duty enlisted service. This
period is normally 3 years or, for the first award only, upon termination
of service of on or after 27 June 1950 of less than 3 years but more
than 1 year.
DISCUSSION AND CONCLUSIONS:
1. The applicant received numerous awards of the AGCM during the period
November 1997 through 20 October 2004.
2. Evidence of record shows he received the AGCM (3rd Award) for the
period 13 May 1994 through 12 May 1997 and the AGCM (4th Award) for the
period
12 May 1997 through 11 May 2000.
3. The applicant also received a duplicate award of the AGCM (3rd Award)
for the period 13 May 2000 through 12 May 2003 based on Permanent Order
318-03, Installation Troop Command, Military Personnel Department, U.S.
Army Garrison-Hawaii, dated 14 November 2003. This award as pertains to
award of the AGCM (3rd Award) to the applicant should be revoked.
4. The applicant provided a copy of Permanent Order Number 294-01 awarding
him the AGCM (5th Award) for the period 13 May 2000 through 12 May 2003.
Therefore, he is entitled to correction of his records to show this award.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that
Department Permanent Order 318-03, Installation Troop Command Military
Personnel Department, U.S. Army Garrison-Hawaii of the individual concerned
be removed from his OMPF and that his records be amended to show Permanent
Order Number 294-01, dated 20 October 2004 awarding him the AGCM (5th
Award) for the period 13 May 2000 through 12 May 2003.
