      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his DD Form 214 dated 10 March 2005 be
corrected to reflect four awards of the Army Commendation Medal (ARCOM),
three awards of the Army Achievement Medal (AAM), his award of the United
Nations Medal – Haiti, and his Achievement Medal for Civilian Service.

2.  The applicant states, in effect, that his records should accurately
reflect all of his decorations and awards.

3.  The applicant provides a copy of his award of the United Nations Medal
– Haiti, a copy of his Achievement Medal for Civilian Service, copies of
his orders awarding him three AAMs, and an incomplete copy of a
recommendation for award of the ARCOM (DA Form 638) dated 2 May 1999 that
does not contain any orders data.

CONSIDERATION OF EVIDENCE:

1.  On 3 January 2004, while serving as a United States Army Reserve (USAR)
aviation Chief Warrant Officer Four (CW4), he was ordered to active duty in
support of Operation Enduring Freedom.

2.  On 10 March 2005, he was honorably released from active duty due to
completion of required active service and was returned to his USAR unit.
His DD Form 214 issued at the time shows that he was awarded three awards
of the ARCOM.  His record also does not reflect his three awards of the AAM
and his award of the United Nations Medal – Haiti.

3.  The applicant received an Achievement Medal for Civilian Service on 22
July 1999 covering the period from 1 June 1998 through 6 November 1998.
That award is also not entered on his DD Form 214.

4.  The applicant’s records contain orders awarding him three awards of the
ARCOM.  However the DA Form 638 provided by the applicant does not contain
any orders data showing that the award was actually made.  The award is
also not contained in his Official Military Personnel File (OMPF).

5.  Army Regulation 635-5 serves as the authority for the preparation,
issuance and distribution of the DD Form 214.  It provides, in pertinent
part, that only those awards contained in Army Regulation 600-8-22
(Military Awards) will be entered on the DD Form 214.
DISCUSSION AND CONCLUSIONS:

1.  The applicant has provided a DA Form 638 dated 2 May 1999 showing that
he was recommended for award of the ARCOM; however, he has failed to
provide orders showing that the award was actually issued.  Therefore,
absent orders awarding him a fourth award of the ARCOM, there is no basis
to correct that entry on his DD Form 214.

2.  He has provided sufficient evidence however to show that he was awarded
three awards of the AAM and the United Nations Medal –Haiti.  Accordingly,
those awards should be added at this time.

3.  The applicant’s award of the Achievement Medal for Civilian Service is
not an authorized award for entry on the DD Form 214.  Accordingly, there
is no basis to grant that portion of his request.

BOARD DETERMINATION/RECOMMENDATION:

1.  Notwithstanding the staff DISCUSSION AND CONCLUSIONS above, the Board
determined that the evidence presented was sufficient to warrant a
recommendation for partial relief.  As a result, the Board recommends that
all Department of the Army records of the individual concerned be corrected
by showing that he was awarded the AAM (third award) and the United Nations
Medal-Haiti.

2.  The Board further determined that the evidence provided by the
applicant was sufficient to award the fourth award of the ARCOM and to add
it to his DD Form 214.





3.  The Board also determined that the evidence presented is insufficient
to warrant a portion of the requested relief.  As a result, the Board
recommends denial of so much of the application that pertains to adding his
Achievement Medal for Civilian Service to his DD Form 214.
