                            RECORD OF PROCEEDINGS

      IN THE CASE OF:

      BOARD DATE: 3 November 2005
      DOCKET NUMBER: AR20050001301

I certify that hereinafter is recorded the true and complete record
of the proceedings of the Army Board for Correction of Military Records in
the case of the above-named individual.

| |Mr. Carl W. S. Chun | |Director |
| |Ms. Wanda L. Waller | |Analyst |

The following members, a quorum, were present:

| |Mr. Thomas Howard | |Chairperson |
| |Mr. John Infante | |Member |
| |Ms. Carmen Duncan | |Member |

The Board considered the following evidence:

Exhibit A - Application for correction of military records.

Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests award of the National Defense Service Medal
(NDSM).

2. The applicant states he was on active duty for training in April 2002.
He states it is his understanding of MILPER Message Number 02-150 that
anyone serving on active duty on or after 11 September 2001 for reasons
other than inactive duty training was eligible for the NDSM.

3. The applicant provides no evidence in support of his application.

CONSIDERATION OF EVIDENCE:

1. Having prior active duty service in the U.S. Navy, the applicant
enlisted in the Army National Guard on 6 April 2000. On 5 April 2001, the
applicant was honorably discharged from the Army National Guard. He
enlisted in the Army National Guard on 11 December 2001. On 10 December
2003, the applicant was honorably discharged from the Army National Guard.

2. The applicant's Army National Guard Retirement Points History Statement
shows he earned 15 active duty points during the period 11 December 2001
through 10 December 2002 and 17 active duty points during the period
11 December 2002 through 10 December 2003.

3. MILPER Message Number 02-150, dated 26 April 2002, provided for the
reinstatement of the NDSM for members of the U.S. Armed Forces serving on
active duty on or after 11 September 2001 to a date to be determined in the
future. The message stated, in pertinent part, that Army National Guard
and U.S. Army Reserve forces personnel on short tours of duty to fulfill
training obligations under an inactive duty training program would not be
considered as performing active service.

DISCUSSION AND CONCLUSIONS:

Evidence of record shows the applicant performed two short tours on active
duty during the period 11 December 2001 to 10 December 2003. One tour may
have been for active duty for training as he states; the other appears to
have been annual training. However, the governing regulation states that
short tours of active duty to fulfill training obligations would not be
considered as performing active service. Therefore, there is insufficient
evidence on which to base award of the NDSM in this case.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

TH_____ JI______ CD______ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable
error or injustice. Therefore, the Board determined that the overall
merits of this case are insufficient as a basis for correction of the
records of the individual concerned.

The applicant states that his National Guard service was from March 1981 to December 1992 with a few breaks in active Army Reserve. Army Regulation 600-8-22 (Military Awards) provides that the National Defense Service Medal is awarded for honorable active service for any period between 2 August 1990 to 25 November 1995. Therefore, the evidence does not justify correcting his records to show this award.

Army Regulation 600-8-22 (Military Awards) provides that the Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency and fidelity during a qualifying period of active duty enlisted service. The applicant requests, in effect, that he be awarded the National Defense Service Medal (NDSM) and that his military records be corrected to show award of the Global War on Terrorism Service Medal (GWOTSM). There is no evidence in the applicant's military records which shows that he was ever mobilized. The applicant contends that he should be awarded the NSDM and that his military records should be corrected to show the award of the GWOTSM.

The evidence of record confirms the applicant served on active duty in the United States for more than 30 consecutive days after 11 September 2001. It further shows that he was awarded the AFEM for his service in support of ODS in Kuwait, and that this award is listed in his record and separation document. He is not entitled to the GWOTEM because he cannot be authorized this award for the same period for which the AFEM or ICM is authorized.

As the applicant has requested that he be awarded the ICM with one bronze service star in lieu of his already-awarded GWOTEM, it would be appropriate at this time to correct his military records to show the award of the ICM with one bronze service star and remove his award of the GWOTEM. Therefore, it would be appropriate at this time to correct his military records to show the award of the Overseas Service Ribbon with Numeral "2" to denote his completion of two overseas tours. As a...
