         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, that his Certificate of Release or Discharge from Active Duty, DD Form 214, for the period ending 13 March 2002 be amended to show the second award of the National Defense Service Medal (NDSM).

3. The applicant states Military Personnel Message Number 02-150 established a new eligibility period for award of the NDSM and he was on active duty during that time period.

4. The applicant’s military records show that, after having had prior active duty in the Regular Army from 17 November 1987 – 16 November 1989, he transferred to a Troop Program Unit (TPU) in the U. S. Army Reserve (USAR). During retirement year ending 9 August 1991, he earned 72 retirement points. He served in a TPU until 14 July 1992, when he transferred to the USAR Control Group (Reinforcement). He was discharged from the USAR on 9 August 1995.

5. The applicant enlisted in the Army National Guard on 19 December 2000. He was ordered to active duty from 6 September 2001 – 13 March 2002 in support of Operation Joint Forge. His DD Form 214 for the period ending 13 March 2002 shows that he was awarded, among other awards and decorations, one NDSM.

Military Personnel Message Number 02-150, subject: Reinstatement of the National Defense Service Medal, referenced Office of the Deputy Secretary of Defense Memorandum, same subject, dated 26 April 2002. The memorandum authorized reinstatement of the NDSM. It stated that the NDSM is awarded for honorable active service and includes the following inclusive periods: 27 June 1950 to 27 July 1954; 1 January 1961 to 14 August 1974; 2 August 1990 to 30 November 1995; and 11 September 2001 to a date to be determined. It stated that, as a one-time only exception, members of the Army National Guard and USAR who were part of the Selected Reserve in good standing were authorized the NDSM per Executive Orders 12778 dated 18 October 1991 for the period 2 August 1990 to 30 November 1995. A bronze service star will be worn to signify receipt of a second or subsequent award.

CONCLUSIONS:

1. The applicant was awarded the basic NDSM for his service as a member in good standing of the Selected Reserve during the NDSM eligibility period 2 August 1990 to 30 November 1995. He then served on active duty with the Army National Guard during the period 6 September 2001 – 13 March 2002. His DD Form 214 for the period ending 13 March 2002 reflected his award of the basic NDSM.

2. After the applicant was released from active duty, the Deputy Secretary of Defense announced reinstatement of the NDSM for the period 11 September 2001 to a date to be determined. As the applicant served honorably on active duty during this new eligibility period, he meets the eligibility criteria to wear one bronze service star on the NDSM and it would be equitable to amend his DD Form 214 for the period ending 13 March 2002 to show this fact.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That the applicant’s DD Form 214 for the period ending 13 March 2002 be amended to delete National Defense Service Medal and to add the National Defense Service Medal with one bronze service star.
