         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that the fourth award of the Joint Meritorious Unit Award (JMUA) be added to block 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) on his DD Form 214 (Certificate of Release or Discharge from Active Duty).

3. The applicant states that at the time he executed his DD Form 214, he was not yet authorized a fourth award of the JMUA for his time in the Defense Intelligence Agency (DIA). He states that the JMUA was awarded to the DIA for the period April 1999 to April 2002 authorized by the Secretary of Defense on 7 October 2002. In support of his application, the applicant provided a copy of the citation for JMUA for the period April 1999 to April 2002; a copy of his Officer Record Brief; and a copy of his DD Form 214.

4. The applicant’s military records show that he was appointed as a commissioned officer in the Regular Army on 27 May 1981 in the rank of second lieutenant. Upon completion of over 20 years of honorable service, he was retired in the rank of major on 31 May 2001.

5. The applicant's DD Form 214 shows entitlement to three awards of the JMUA in block 13.

6. The applicant's Officer Record Brief shows he was assigned to the DIA from 5 June 1996 to 4 June 1999.

7. The applicant provided a copy of the citation, dated 7 October 2002, which shows the JMUA was awarded to the DIA for meritorious achievement from April 1999 to April 2002.

8. Department of Defense 1348.33-M (Manual of Military Decorations & Awards) provides, in pertinent part, that the JMUA is awarded in the name of the Secretary of Defense and is intended to recognize joint units and activities for meritorious achievement or service, superior to that which is normally expected. All joint units and activities are eligible for award of the JMUA in recognition of exceptionally meritorious conduct in the performance of outstanding service.

CONCLUSIONS:

1. The applicant's DD Form 214 currently shows entitlement to three awards of the JMUA.

2. The citation provided by the applicant shows he was assigned to the DIA during the period it was authorized award of the JMUA.

3. Therefore, the applicant is entitled to an additional award of the JMUA and correction of his DD Form 214 to show a total of four awards of the JMUA.
4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the individual concerned was awarded the JMUA (Fourth Award).
