         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that her records be corrected to show that she entered on active duty on 1 August 2000, vice 24 July 2000; that she was separated from active duty on 5 August 2002, vice 23 July 2002, and that the effective date of her pay grade is 15 July 1998, vice 1 July 2000.

3. The applicant provides copies of her DD Form 214, amendments to her active duty order, and a copy of her promotion order.

4. The applicant enlisted in the Army Reserve for 6 years on 31 August 1978 in the delayed entry program (DEP). She was discharged from the DEP upon her enlistment in the Regular Army for three years on 29 November 1978. She had 2 months and 28 days of inactive service. The applicant continued on active duty until her discharge on 25 January 1989 for a total of 10 years, 1 month, and 27 days of active service. She enlisted in the Army Reserve for three years on 26 January 1989 immediately after her discharge. On 29 November 1990 she was ordered to active duty in support of Operation Desert Shield/Desert Storm. She was released from active duty on 28 May 1991 and transferred to a Reserve unit at Fort Belvoir, Virginia. Her DD Form 214 shows that she had 6 months of active service, 10 years, 1 month, and 27 days of prior active service, and 2 years, 1 month, and 1 day of prior inactive service.

5. Orders 170-84, 99th Regional Support Command, dated 19 June 1998, shows that the applicant was promoted to Sergeant First Class effective and with a date of rank of 15 July 1998.

6. The applicant continued her service in the Army Reserve until she was ordered to active duty in 2000.

7. Orders A-07-004557, published by the Total Army Personnel Command at St. Louis on 21 July 2000 ordered the applicant to active duty with the Army Review Boards Agency with a reporting date of 24 July 2000 and an active duty commitment of 2 years. That order stipulated that the applicant’s active duty tour was to end on or about 23 July 2002. Those orders were amended on 31 July 2000 directing a reporting date of 1 August 2000. They were further amended on 22 July 2002 to show an active duty commitment of 2 years and 5 days with an ending date of 5 August 2002.

8. She had 9 years, 2 months, and 3 days of inactive service between the time she was released from active duty on 28 May 1991 and the time she was ordered to active duty on 1 August 2000. That time, added to the previous time of 2 years, 1 month, and 1 day of prior inactive service would mean that she had a total of 11 years, 3 months, and 4 days of inactive service.


CONCLUSIONS:

1. The applicant was promoted to Sergeant First Class on 15 July 1998. The effective date of her pay grade on her DD Form 214 should reflect that date.

2. The applicant’s 21 July 2000 active duty orders were amended as indicated above. Consequently, her DD Form 214 should show that she entered on active duty on 1 August 2000 and was separated from active duty on 5 August 2002. Her net active service on that form should show 2 years, 0 months, and 5 days.

3. Item 12d of her DD Form 214 should reflect her total prior active service of 10 years, 7 months, and 27 days. Item 12e of that form should show that she had 11 years, 3 months, and 4 days of prior inactive service.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that:

a. the applicant was promoted to Sergeant First Class, pay grade E-7, effective and with a date of rank of 15 July 1998;

b. she entered on active duty on 1 August 2000, was separated from active duty on 5 August 2002, and had 2 years, 0 months, and 5 days of net active service; and

c. that she had 10 years, 7 months, and 27 days of total prior active service, and 11 years, 3 months, and 4 days of total prior inactive service.
