THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests the following corrections to her DD Form 214 (Certificate of Release or Discharge from Active Duty) with a separation date of 11 June 2002:

* add initial entry training 
* change the length of the Administrative Specialist Course from 8 weeks to 
5 weeks
* add the Postal Operations Course
* add her deployment from 7 March 2000 to 22 September 2000
* add the North Atlantic Treaty Organization (NATO) Medal
* add a certificate of achievement

2.  The applicant states she believes her DD Form 214 is incorrect due to these errors.  At the time the form was completed, the errors listed were not detected.  Upon reviewing her records it was discovered that some of the information on her DD Form 214 was incorrect.

3.  The applicant provides:

* two certificates for completion of Army courses
* orders awarding her military occupational specialty (MOS) 71L (Administrative Specialist)
* orders awarding her the additional skill identifier (ASI) F5 (Postal Operations)
* deployment orders from 1 March 2000 to 20 September 2000
* NATO Medal Certificate 
* an undated Certificate of Achievement

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  On 12 August 1997, she enlisted in the Regular Army.  She completed basic combat and advanced individual training and was awarded military occupational specialty 71L (Administrative Specialist).

3.  She provided a certificate for completion of the Administrative Specialist Course that shows she attended from 24 November 1997 through 15 January 1998, a period of 5 weeks.  The Army Training Requirements and Resources System (ATRRS) shows the course length for "Executive Administrative Assistant Course" is 5 weeks.  She was awarded MOS 71L upon completion of the course.

4.  She provided a certificate for completion of the Postal Operations Course on 27 February 1998.  The inclusive dates of the course are not shown on the certificate.  ATRRS shows the course length for Postal Operations (Phase I and II) is 4 weeks.  She was awarded ASI F5 upon completion of the course.

5.  Headquarters, III Corps and Fort Hood, Fort Hood, TX, Permanent Orders 
54-2, dated 23 February 2000, with attached list, shows a temporary change of station from Fort Hood, TX to Tuzla, Bosnia in support of Operation Joint Forge (OJF) Task Force Eagle effective on or about 1 March 2000.  The applicant is listed on the attached list.

6.  Headquarters, Multinational Division (North), Tuzla, Bosnia-Herzegovina Orders 259-007, dated 15 September 2000, and Annex 1, released listed detachment members from deployment and returned them to their unit at Fort Hood, TX effective on or about 20 September 2000.  The applicant is listed on Annex 1 of the orders.

7.  She provided a certificate showing she was awarded the NATO Medal for service with NATO on operations in relation to the former Yugoslavia during the period 7 March 2000 to 22 September 2000.

8.  On 11 June 2002, she was released from active duty.  Item 12c (Net Active Service This Period) shows she completed 4 years and 10 months of net active service this period .  Item 12f (Foreign Service) of her DD Form 214 does not show any foreign service.  Item 18 (Remarks) does not contain an entry for her deployment.  Her DD Form 214 shows she was awarded or is authorized the:

* Army Lapel Button
* Army Commendation Medal
* Army Achievement Medal
* Army Good Conduct Medal
* Army Service Ribbon

9.  Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards.

	a. The Armed Forces Expeditionary Medal is authorized for qualifying service after 1 July 1958 in military operations within specific geographic areas during specified time periods. An individual, who was not engaged in actual combat or equally hazardous activity, must have been a bona fide member of a unit participating in, or be engaged in the direct support of, the operation for 
30 consecutive or 60 nonconsecutive days provided this support involved entering the area of operations.

	b. The Armed Forces Service Medal is awarded to service members of the Armed Forces of the United States who, after 1 June 1992, who participate or have participated, as service members of U.S. military units, in a U.S. military operation that is deemed to be a significant activity and encounter no foreign-armed opposition or imminent threat of hostile action.

		(1)  May be authorized for significant U.S. military activities for which no other U.S. campaign or service medal is appropriate.

		(2)  May be awarded for U.S. military operations in direct support of the UN or NATO, and for operations of assistance to friendly foreign nations.

		(3)  Service members must be bona fide members of a unit participating in or engaged in direct support of the operation for 30 consecutive days in the area of operations (or for the full period when an operation is less than 30 days duration) or for 60 consecutive days provided this support involves entering the area of operations. 

	c.  All Soldiers on active duty on or after 11 September 2001 until a date to be determined and have served 30 consecutive days or 60 nonconsecutive days are authorized the Global War on Terrorism Service Medal

10.  Department of Defense (DOD) 1348.33-M, Volume 2, enclosure 3, paragraph 4i states, in accordance with section 572 of Public Law 105-85, as an exception to policy, service members who participated in, or provided direct support to, Operation JOINT ENDEAVOR (OJE), Operation JOINT GUARD (OJG), or OJF who were deployed to Bosnia-Herzegovina or Croatia, or aboard U.S. naval vessels operating in the Adriatic Sea, or operating in the air space above these respective areas, are authorized the Armed Forces Expeditionary Medal in addition to the Armed Forces Service Medal, provided they meet Armed Forces Expeditionary Medal eligibility criteria. 

11.  A list of authorized operations for the award of the Armed Forces Expeditionary Medal provided by DOD, Office of the Under Secretary for Personnel and Readiness, shows the Armed Forces Expeditionary Medal is authorized for participants in OJF, Bosnia-Herzegovina and Croatia, from 
21 June 1998 - 2 December 2004.

12.  A list of authorized operations for the award of the Armed Forces Service Medal provided by DOD, Office of the Under Secretary for Personnel and Readiness, shows the Armed Forces Service Medal is authorized for participants in OJF, Bosnia-Herzegovina and Croatia, from 21 June 1998 - 2 December 2004.

13.  Army Regulation 635-8 (Separation Processing and Documents) establishes the standardized policy for preparing and distributing the DD Form 214.

   a.  In block 12f (Foreign Service) enter the total amount of service performed outside the continental United States (OCONUS) during the period covered in block 12c.  In addition, list periods of deployed service in item 18.

   b.  Formal in-service (full-time attendance) training courses successfully completed during the period of service covered will be entered in Item 14.  The entry is to include the title, length in weeks, and the year completed.  The information entered in Item 14 is to assist the member after separation in job placement and counseling; therefore training courses for combat skills will not be listed.
   c.  All federally recognized awards and decoration for all periods of service are listed in Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized).

	d.  When an active duty Soldier is deployed with his/her unit during the period covered by the DD Form 214, an entry will be made in item 18 to show the name of the country deployed to and the inclusive dates.

DISCUSSION AND CONCLUSIONS:

1.  Training courses for combat skills are not listed on the DD Form 214.  Her completion of basic combat training is not to be shown on her DD Form 214.

2.  Her certificate for completion of the Administrative Specialist Course and ATRRS show the duration of the course is 5 weeks vice 8 weeks.

3.  She was awarded the ASI F5, indicating she completed the Postal Operations Course.  ATRRS shows the duration of this course was 4 weeks.

4.  Orders show she was deployed to Tuzla, Bosnia, in support of OJF, Task Force Eagle.  Her orders and her certificate for the award of the NATO Medal show her dates of deployment were 7 March 2000 to 22 September 2000, a period of 6 months and 20 days.  Item 12f of her DD Form 214 should be amended to show "00 06 20" and her dates of deployment should be entered in item 18. 

5.  She provided a certificate awarding her the NATO Medal.  Based on her deployment to Bosnia-Herzegovina, and as provided in DOD 1348.33-M, Volume 2 she is authorized the:

* Armed Forces Expeditionary Medal
* Armed Forces Service Medal

6.  She met the criteria for the Global War on Terrorism Service Medal.

7.  Certificates of achievement are not entered on the DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending her DD Form 214 with a separation date of 11 June 2002 as follows:

	a.  Item 12f - delete "0000 00 00" and enter "0000 06 20."

	a.  Item 14 - change the duration of the Administrative Specialist Course from 
"8 weeks" to read "5 weeks."

	b.  Item 14 - add the entry "Postal Operations Course, 4 weeks, 1998."

	d.  Item 18 - add the entry "Service in Bosnia - 7 March 2000 to 22 September 2000."

	e.  Add the following awards:

* Armed Forces Expeditionary Medal
* Armed Forces Service Medal
* Global War on Terrorism Service Medal
* NATO Medal









2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to basic combat training and her certificate of achievement.
