         I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual. A quorum was present during the further consideration and deliberation. The findings appearing in proceedings dated 6 December 2001 were affirmed. The following additional findings, conclusions, and recommendation were adopted by the Board.

         The Board convened at the call of the Director on the above date to reconsider the conclusions and recommendation appearing in proceedings dated 6 December 2001.

         The applicant and counsel, if any, did not appear before the Board.

THE BOARD ADDITIONALLY FINDS:

6. On 6 December 2001, the Board recommended that the applicant be considered by a standby advisory board for promotion consideration to chief warrant officer three under 2001 criteria.

7. The applicant was recommended for promotion to chief warrant officer three under 2001 criteria by a standby advisory board adjourning on 9 May 2002.

THE BOARD ADDITIONALLY CONCLUDES:

3. At the time of the Board’s 6 December 2001 decision in this case, it was the intent of the Board to make the applicant’s record as administratively correct as it should properly have been at the time.

4. In view of the facts and circumstances surrounding this matter, the interest of justice would best be served by now correcting the Departmental records to show that the applicant was recommended for promotion to chief warrant officer three. The interest of justice would also be served by correcting the applicant’s records to show that his name was integrated onto the appropriate recommended list and that he was promoted to chief warrant officer three on his date of eligibility thereof, as determined by appropriate Departmental officials using the criteria cited.

5. In view of the foregoing findings and conclusions, it would be appropriate to further correct the applicant’s records as recommended below.

THE BOARD RECOMMENDS:

That all of the Department of the Army records related to this case be further corrected:

         a. by showing the individual concerned was selected for promotion to chief warrant officer three under 2001 criteria; and

         b by showing he was promoted to chief warrant officer three on his date of eligibility thereof, as determined by appropriate Departmental official









using the criteria cited, provided he was otherwise qualified and met all other prerequisites for promotion.
