         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Kosovo Campaign Medal in item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) for his support in Operation Joint Guardian in Kosovo.

3. The applicant states that he was called to active duty on 11 March 2002 (sic 2001) in support of Operation Joint Guardian in Kosovo and was released from active duty on 21 September 2002 (sic 2001). He claims that the Federal Civil Service will only recognize Veteran Readjustment Appointment if the campaign ribbon is listed in box 13 of the DD Form 214. In support of his application, he submits a copy of his DD Form 214, orders which released him from active duty, and orders which called him to active duty.

4. The applicant’s military records show that he initially served in the Army National Guard from March 1971 to September 1986. His Federal recognition in the Army National Guard was withdrawn on 25 September 1986 and he was transferred to the U.S. Army Reserve (USAR). The applicant continued to serve in the USAR and was retired on 28 February 2002 in the rank of lieutenant colonel.

5. The applicant provided a copy of his DD Form 214 which shows he was ordered to active duty on 11 March 2001 in support of Operation Joint Guardian. This discharge document does not list award of the Kosovo Campaign Medal in item 13.

6. The applicant also provided a copy of MOB Support Detachment Orders Number 01-054-003, dated 23 February 2001, which shows he was ordered to active duty in support of Operation Joint Guardian on 11 March 2001.

7. Orders were published by the U.S. Infantry Center at Fort Benning, Georgia, on 5 September 2001, which released the applicant from active duty with an effective date of 21 September 2001.

8. MILPER Message Number 00-180 approved establishment of the Kosovo Campaign Medal for service in support of Operations Allied Force, Joint Guardian, Allied Harbor, Sustain Hope/Shining, Noble Anvil, or Task Force Hawk, Task Force Saber, or Task Force Hunter with the Kosovo Air Campaign or the Kosovo Defense Campaign. The Kosovo Air Campaign began on 24 March 1999 and ended on 10 June 1999. The Kosovo Defense Campaign began on 11  June 1999 and will end on a date to be determined. To be eligible for award of the Kosovo Campaign Medal an individual must be in a unit participating in or directly supporting the operation for 30 consecutive days or 60 nonconsecutive and/or meet other established criteria. A bronze service star will worn on this ribbon to denote participation in each authorized campaign.
CONCLUSIONS:

1. Evidence of record shows the applicant served on active duty in support of Operation Joint Guardian from 11 March 2001 to 21 September 2001. Therefore, he is entitled to award of the Kosovo Campaign Medal and correction of his DD Form 214 to show this award.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the individual concerned was awarded the Kosovo Campaign Medal.
