         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his dates of service in Kosovo.

3. The applicant states that he served in Urosevac, Kosovo, for six months and this service is not shown on his DD Form 214. In support of his application, he submits deployment orders, dated 6 August 1999.

4. The applicant’s military records show that he enlisted on 18 February 1999 for a period of 3 years. He served as an infantryman and was discharged under honorable conditions (general) on 31 May 2001.

5. The applicant's DD Form 214 does not show his dates of service in Kosovo. Item 12f (Foreign Service) on his DD Form 214 shows the entry, "0000 00 00." His DD Form 214 does not show any awards or decorations for service in Kosovo.

6. Permanent Orders 218-03, dated 6 August 1999, show the applicant's unit was deployed on or about 6 September 1999 for 179 days to Kosovo to provide force protection in support of Operation Joint Guardian.

7. There is no evidence in the available records which shows the applicant's inclusive dates of service in Kosovo.

8. Section D (Overseas Service) on the applicant's Enlisted Record Brief does not reflect any overseas service.

9. Item 5 (Oversea Service) on the applicant's DA Form 2-1 (Personnel Qualification Record) is blank.

10. Army Regulation 635-5 establishes the standardized policy for preparing and distributing the DD Form 214. In pertinent part, it directs that foreign service performed during the period covered by the DD Form 214 will be entered in item 12f. The regulation also states that the amount of foreign service will be taken from the soldier’s Enlisted Record Brief or Officer Record Brief.

11. MILPER Message Number 00-180 approved establishment of the Kosovo Campaign Medal for service in support of Operations Allied Force, Joint Guardian, Allied Harbor, Sustain Hope/Shining, Noble Anvil, or service with Task Force Hawk, Task Force Saber, or Task Force Hunter during the Kosovo Air Campaign or the Kosovo Defense Campaign. The Kosovo Air Campaign began on 24 March 1999 and ended on 10 June 1999. The Kosovo Defense Campaign
began on 11 June 1999 and will end on a date to be determined. To be eligible for award of the Kosovo Campaign Medal an individual must be in a unit participating in or directly supporting the operation for 30 consecutive days or 60 nonconsecutive and/or meet other established criteria. A bronze service star will be worn on this ribbon to denote participation in each authorized campaign.

CONCLUSIONS:

1. The Board noted the applicant’s request to show his dates of service in Kosovo on his DD Form 214. However, the applicant’s inclusive dates of service in Kosovo are not contained in the available service personnel records. As a result, the Board is unable to determine his exact dates of service in Kosovo. Therefore, there is no basis for granting the applicant’s request.

2. The applicant provided evidence of record which shows that he was deployed on or about 6 September 1999 to Kosovo and participated in direct support of Operation Joint Guardian. Therefore, the applicant is entitled to award of the Kosovo Campaign Medal and correction of his DD Form 214 to show this medal.

3. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records, but only as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the Kosovo Campaign Medal.

2. That so much of the application as is in excess of the foregoing be denied.
