         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to include his medals and ribbons awarded to him for service in Cuba, Bosina and Kosovo.

3. The applicant states he was awarded and is entitled to receive the U.S. Coast Guard Meritorious Unit Commendation, and the Special Operations Service Ribbon for service in Cuba, the Kosovo Campaign Medal, and the Armed Forces Expeditionary Medal and the Army Superior Unit Emblem for service in Bosnia.

4. The applicant’s military records show that he enlisted in the Regular Army on 20 July 1988, and served until he was honorably discharged in June 2000.

5. On 9 September 1994, he was assigned to Guantanamo Bay, Cuba as a part of the Joint Task Force 160, III Corps. In December 1995, the Commander of the Coast Guard awarded the Joint Task Force 160 the Special Operations Service Ribbon and the Coast Guard Meritorious Unit Commander for Operation Sea Signal, for the period 5 November 1994 through 1 February 1996. Communication with the U.S. Total Army Personnel Command, Awards Branch verified the authorization for the awards and placement on the applicant’s DD form 214.

6. In December 1996, the applicant was assigned to Bosnia in support of Operation “Joint Endeavor” (Task Force Eagle). In March 1997, while serving in Bosnia, he was further assigned to the Stabilization Force (SFOR) with Operation “Joint Guard” (Task Force Eagle). The Army Superior Unit Award (ASUA) was awarded to the Task Force Eagle Stabilization Force for the period 4 April 1997 to 21 October 1997.

7. The applicant was assigned to Kosovo from June 1999 to November 1999 in support of Operation “Joint Guardian.”

8. Army Regulation 600-8-22, provides, in pertinent part, that the Armed Forces Expeditionary Medal is authorized for participants in military operations within a
specific geographic area during a specified time period. An individual, who was not engaged in actual combat or equally hazardous activity, must have participated in operations or in direct support of operations for 30 consecutive or 60 nonconsecutive days.

9. MILPER Message Number 00-180 approved establishment of the Kosovo Campaign Medal for service in support of Operations Allied Force, Joint Guardian, Allied Harbor, Sustain Hope/Shining, Noble Anvil, or service with Task Force Hawk, Task Force Saber, or Task Force Hunter during the Kosovo Air Campaign or the Kosovo Defense Campaign. The Kosovo Air Campaign began on 24 March 1999 and ended on 10 June 1999. The Kosovo Defense Campaign began on 11  June 1999 and will end on a date to be determined. To be eligible for award of the Kosovo Campaign Medal an individual must be in a unit participating in or directly supporting the operation for 30 consecutive days or 60 nonconsecutive and/or meet other established criteria.

CONCLUSIONS:

1. The applicant served in Cuba from September to December 1994, and was awarded the U.S. Coast Guard Meritorious Unit Commendation and the Special Operations Service Ribbon, for the period 5 November 1994 through 1 February 1996. These awards should be reflected on his separation document.

2. Evidence shows the applicant was awarded the Army Superior Unit Award for his service in Bosnia.

3. Evidence shows the applicant was authorized wear of the Kosovo Campaign Medal. Therefore, his records should be corrected to show this medal.

4. Evidence shows the applicant served in Bosnia in support of Operation “Joint Guard” and is entitled to award of the Armed Forces Expeditionary Medal.

5. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the applicant was awarded the U.S. Coast Guard Meritorious Unit Commendation, the Special Operations Service Ribbon, the Army Superior Unit Award, the Kosovo Campaign Medal, and the Armed Forces Expeditionary Medal.
