         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his DD Form 214 be corrected to show that he was released from active duty on 25 June 2002 vice the 20 June 2002 date shown.

3. He states that he completed an active duty tour on 25 June 2002 and reenlisted on 26 June 2002.

3. The applicant’s military records show that he was ordered to active duty for two years with a reporting date to the Army Review Boards Agency in Arlington, Virginia of 26 June 2000.

4. The applicant’s DD Form 214 shows that he was released from active duty on 20 June 2002 upon completion of his required active service. However, that form also shows that he entered on active duty on 20 June 2000, and that he had 2 years and 1 day of service.

5. The applicant reenlisted in the Regular Army for 3 years on 26 June 2002.

CONCLUSIONS:

1. The applicant entered on active duty on 26 June 2000 and was released two years later upon completion of his tour. His DD Form is incorrect, in the entry showing the date he entered on active duty and the entry showing his separation date.

2. Consequently, the applicant’s DD Form 214 should be corrected to show that he entered on active duty on 26 June 2000 and that he was released from active duty on 25 June 2002.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.


RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by correcting the applicant’s DD Form 214 to show that he entered on active duty on 26 June 2000 and that he was released from active duty on 25 June 2002.
