         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his DD Form 214 (Armed Forces Report of Separation) be corrected to show his pay grade as PFC (Private First Class) E-3 vice PVT E-2 as shown.

3. The applicant states that his pay voucher from the National Guard shows his pay grade as E-4.

4. The applicant’s military records show that he enlisted in the Army for two years on 27 December 1966. He was assigned to Fort Gordon, Georgia for training and was advanced to pay grade E-2 effective 3 March 1967 per Headquarters, 1st Training Brigade letter dated 1 March 1967. He completed advanced training at Fort Jackson, South Carolina, and in June 1967 was assigned to the Special Processing Detachment, Special Troops, at Fort Dix, New Jersey.

5. Orders published by Fort Dix on 3 January 1969 show that the applicant was assigned to Fort Dix on 19 June 1967 after having returned from AWOL and having been DFR (dropped from the rolls). Those orders show that the applicant had surrendered to the Provost Marshal Office at Fort Dix on 19 June 1967, and that he was currently confined in the Fort Dix stockade. Those orders show his pay grade as PVT E-2.

6. Orders published by Fort Dix on 4 January 1969 show that the applicant was released from active duty and transferred to the Army Reserve Control Group. His rank on those orders is shown as PVT.

7. The applicant was released from active duty on 4 January 1969. His DD Form 214 shows that he had 2 years and 8 days of service. It also shows his rank and pay grade as PVT E-2 with a date of rank of 1 March 1967.

8. The applicant’s DA Form 20 (Enlisted Qualification Record) shows that he was advanced to PVT E-2 on 1 March 1967, and to PFC E-3 on 29 May 1968.

9. The applicant’s military pay vouchers are included with his records. His voucher for the pay period 1-30 June 1968 shows that the applicant was advanced to [pay grade] E-3 effective 29 May 1968 per Unit Order 55, Company D (Provisional) Special Troops. His vouchers subsequent to June 1968, to include his voucher for the period 1-4 January 1969 show his pay grade as E-3. All vouchers show that he received pay in the grade of E-3 effective with his advancement to that grade on 29 May 1968.

CONCLUSIONS
:

1. The applicant was advanced to pay grade E-3 effective 29 May 1968 and held that grade at the time of his release from active duty. Consequently, his DD Form 214 should reflect his rank and pay grade as PFC E-3, with a date of rank of 29 May 1968.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the applicant was advanced to the rank and pay grade of PFC E-3 with a date of rank of 29 May 1968.
