         The Board, established pursuant to authority contained in 10 U.S.C. 1552, convened at the call of the Chairperson on the above date. In accordance with Army Regulation 15-185, the application and the available military records pertinent to the corrective action requested were reviewed to determine whether to authorize a formal hearing, recommend that the records be corrected without a formal hearing, or to deny the application without a formal hearing if it is determined that insufficient relevant evidence has been presented to demonstrate the existence of probable material error or injustice.

         The applicant requests correction of military records as stated in the application to the Board and as restated herein.

         The Board considered the following evidence:

APPLICANT REQUESTS: In effect, that the Presidential Unit Citation (PUC) be entered on his Report of Separation from Active Duty, DD Form 214.

APPLICANT STATES: That he received the PUC while stationed at the 360th ASA Group, Vint Hill Farms, Virginia from 1977 - 1978. He provides no supporting evidence.

EVIDENCE OF RECORD: The applicant's military records show:

He enlisted in the Regular Army on 30 May 1974.

The applicant's Personnel Qualification Record, DA Form 2-1, shows that he was assigned to Army Security Agency (later redesignated the U. S. Army Intelligence and Security Command) during his entire service. On 1 August 1977, he was assigned to the 370th Army Security Agency Company Operations, Vint Hill Farms Station, Warrenton, VA. He was reassigned to Company D, U. S. Army Intelligence and Security Command, Fort Meade, MD on 1 June 1978. He was separated on 21 November 1978 and placed on the Temporary Disability Retired List.

Department of the Army Pamphlet 672-3, Unit Citation and Campaign Participation Credit Register, shows that no awards of the PUC have been approved since the end of the war in Vietnam.

Army Regulation 600-8-22 provides, in pertinent part, that the PUC is awarded for extraordinary heroism in action. A unit must display such gallantry, determination, and esprit de corps in accomplishing its mission as would warrant award of the Distinguished Service Cross to an individual.

Army Regulation 670-1 prescribes the authorization for wear of uniforms and prescribes the awards, insignia and accouterments authorized for wear on the uniform. In pertinent part, it states that a soldier may wear a unit award permanently if the individual was assigned to and present for duty with the unit any time during the period cited. An individual who was not present with a unit during the period cited for permanent wear of a unit award may be authorized temporary wear only for the duration of assignment to the unit.

DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:

1. The PUC is awarded to a unit for extraordinary heroism in action. The evidence of record shows that the PUC has not been awarded since the war in Vietnam ended.

2. The applicant did not enlist in the Army until after the end of the war in Vietnam. It appears he may have worn the PUC on a temporary basis; therefore, it would not be reflected on his records.

3. In view of the foregoing, there is no basis for granting the applicant's request.

DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
