2. The applicant requests that her Enlistment/Reenlistment Document Armed Forces of the United States, DD Form 4/3, be corrected to show she enlisted in pay grade E-3.
3. The applicant states that she completed three years of the Junior Reserve Officers’ Training Corps (JROTC) program but her recruiter lost her JROTC certificate so she was enlisted in pay grade E-2 instead of E-3.
4. The applicant completed three years of instruction in JROTC on 1 June 2001. The Director of Army Instruction recommended she enlist in the Regular Army in pay grade E-3. The applicant’s military records show she enlisted in the Regular Army on 5 July 2001 in pay grade E-2. Her ROTC Military Training Certificate apparently was reissued on 30 November 2001.
5. In the processing of this case an advisory opinion was obtained from the Retention Management Division, U. S. Total Army Personnel Command. That office noted that the applicant had completed three years of JROTC on 1 June 2001 and received a Senior Service Instructor recommendation for enlistment in the Regular Army in pay grade E-3. In accordance with Army Regulation 601-210, operational change dated 1 April 1999, paragraph 2-20b, an individual is authorized enlistment grade E-3 if he or she has completed three or more years of JROTC with a recommendation from the Senior Service Instructor that he or she be enlisted in that grade. The Retention Management Division opined that the applicant’s enlistment contract was erroneous due to Guidance Counselor error in not properly enlisting her in pay grade E-3.
6. A copy of the advisory opinion was provided to the applicant for comment. She did not respond within the given time frame.
CONCLUSIONS:
1. The evidence of record shows that the applicant was eligible to enlist in the Regular Army on 5 July in pay grade E-3 due to her successful completion of three years of JROTC and a recommendation from her Senior Service Instructor that she enlist in pay grade E-3 but she was enlisted in pay grade E-2 due to Guidance Counselor error.
2. In view of the foregoing, the applicant’s records should be corrected as recommended below.
RECOMMENDATION:
That the applicant’s DD Form 4/3 dated 5 July 2001 be corrected to show she enlisted in pay grade E-3 and that she be paid any and all pay and allowances due as a result of this correction.
