PROCEEDINGS

         IN THE CASE OF:

         BOARD DATE: 16 April 2002
         DOCKET NUMBER: AR2002068050

I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual.

Mr. Carl W. S. Chun Director
Mrs. Nancy Amos Analyst

The following members, a quorum, were present:

Ms. Irene N. Wheelwright Chairperson
Ms. Melinda M. Darby Member
Mr. John T. Meixell Member

The applicant and counsel if any, did not appear before the Board.

The Board considered the following evidence:

Exhibit A - Application for correction of military
records
Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.

2. The applicant requests that her Enlistment/Reenlistment Document Armed Forces of the United States, DD Form 4/3, be corrected to show she enlisted in pay grade E-3.

3. The applicant states that she completed three years of the Junior Reserve Officers’ Training Corps (JROTC) program but her recruiter lost her JROTC certificate so she was enlisted in pay grade E-2 instead of E-3.

4. The applicant completed three years of instruction in JROTC on 1 June 2001. The Director of Army Instruction recommended she enlist in the Regular Army in pay grade E-3. The applicant’s military records show she enlisted in the Regular Army on 5 July 2001 in pay grade E-2. Her ROTC Military Training Certificate apparently was reissued on 30 November 2001.

5. In the processing of this case an advisory opinion was obtained from the Retention Management Division, U. S. Total Army Personnel Command. That office noted that the applicant had completed three years of JROTC on 1 June 2001 and received a Senior Service Instructor recommendation for enlistment in the Regular Army in pay grade E-3. In accordance with Army Regulation 601-210, operational change dated 1 April 1999, paragraph 2-20b, an individual is authorized enlistment grade E-3 if he or she has completed three or more years of JROTC with a recommendation from the Senior Service Instructor that he or she be enlisted in that grade. The Retention Management Division opined that the applicant’s enlistment contract was erroneous due to Guidance Counselor error in not properly enlisting her in pay grade E-3.

6. A copy of the advisory opinion was provided to the applicant for comment. She did not respond within the given time frame.

CONCLUSIONS:

1. The evidence of record shows that the applicant was eligible to enlist in the Regular Army on 5 July in pay grade E-3 due to her successful completion of three years of JROTC and a recommendation from her Senior Service Instructor that she enlist in pay grade E-3 but she was enlisted in pay grade E-2 due to Guidance Counselor error.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That the applicant’s DD Form 4/3 dated 5 July 2001 be corrected to show she enlisted in pay grade E-3 and that she be paid any and all pay and allowances due as a result of this correction.

The evidence of record confirms that the applicant completed 3 years of JROTC and he possessed a recommendation that he be granted an enlistment rank and pay grade of PFC/E-3 from his SSI. Thus, it concludes that it would be appropriate to correct the applicant’s record to show he enlisted in the Army in the rank and pay grade of PFC/E-3 on 23 July 2002, and that this enlistment date was established as both his promotion effective date and DOR. That all of the Department of the Army...

The applicant should have been enlisted in the Reserve in pay grade E-2 on 20 July 1987. That all of the Department of the Army records related to this case be corrected by showing that the...

That officer indicated that the applicant still needed to have his enlistment contract corrected to show his pay grade as E-3. Therefore, the applicant's enlistment contract (DD Form 4/3) should be corrected to show that he enlisted in pay grade E-3 on 11 July 2002. The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the...

The applicant states, in effect, that he qualified for enlistment as a PV2/E-2, but the Military Entrance Processing Station failed to process the documents that entitled him to enlist at that pay grade. The ODCSPER opinion recommends that the applicant's records be corrected to reflect that he enlisted in the military on 27 March 2000 in pay grade E-3 and that he be granted compensatory back pay.
