2. In effect, the applicant requests that her records reflect that she was promoted to pay grade E-3 on
8 November 1987. She encloses a copy of an order published by the 2291st Army Hospital, a Reserve unit in Columbus, Ohio, dated 8 November 1987, promoting her to pay grade E-3 on that date, under the provisions of Army Regulation
140-158, paragraph 4-15.

3. The applicant completed three years of instruction in the Junior Reserve Officers’ Training Corps (JROTC) on
11 June 1987 as attested to by a DA Form 134 (Military Training Certificate) signed by the Senior Army Instructor at Meadowdale High School.

4. The applicant enlisted in the Army Reserve on
20 July 1987. Her enlistment document shows her pay grade as E-1, and that she was scheduled to enter inactive duty for training (IADT) on 3 February 1988.

5. The applicant was advanced to Private First Class, pay grade E-3, effective 8 November 1987, per Headquarters, 2291st United State Army Hospital (USAH) Orders 53-2 of that same date. The authority for the promotion was AR 140-158, paragraph 4-15 (NOTE: The promotion authority erred; the authority should have been paragraph 3-15, vice 4-15).

6. Army Regulation 601-210, then in effect, governs the eligibility criteria, policies, and procedures for enlistment in the Regular Army and the Army Reserve. Table 2-3 of that regulation governs enlistment pay grades and rule B of that table states, in pertinent part, that an applicant who has taken part in JROTC programs and has successfully completed the first 3 years of a prescribed Army, Navy, Marine Corps, or Air Force secondary education division program, but has not been recommended in writing by the senior service instructor concerned will be enlisted in pay grade E-2. The applicant must present a DA Form 134 to support entitlement for a higher enlistment grade, i.e., higher than pay
grade E-1.

7. Army Regulation 140-158, then in effect, provides for the promotion of enlisted soldiers in the Reserve. Paragraph
3-13 states, in pertinent part, that to be promoted to pay grade E-3 a soldier must be qualified in his or her specialty and have completed 4 months time in pay grade E-2. Paragraph 3-15 states that the promotion authority may waive not more than one half of the prescribed time in pay grade for promotion to pay grade E-3, and may waive the promotion criteria to advance soldiers to pay grade E-3 who have enlisted in the Reserve and who have not departed for IADT.

CONCLUSIONS :

1. The applicant should have been enlisted in the Reserve in pay grade E-2 on 20 July 1987.

2. The applicant was properly advanced to pay grade E-3 on
8 November 1987. Her effective date and date of rank for advancement to pay grade E-3 should be 8 November 1987.

3. The applicant should receive all pay and allowances due.

4. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s record as recommended below.

RECOMMENDATION :

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was enlisted in the Reserve on 20 July 1987 in pay grade E-2, that she was advanced to pay grade E-3 effective and with a date of rank of 8 November 1987, and that she receive all due pay and allowances.
