         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military records.

         Exhibit B - Military Personnel Records (including advisory opinion, if any).



THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that his 30 November 2001 enlistment contract be corrected to show that he enlisted in pay grade E-3 vice E-2.

2. The applicant states, in effect, that he had completed 4 years of JROTC (Junior Reserve Officer Training Corps) but there was a problem with his paperwork and no one was assisting him.

3. The applicant provides a copy of his certificate certifying completion of 4 years of JROTC instruction and a recommendation from his Senior Army Instructor that he be authorized an accelerated promotion.

CONSIDERATION OF EVIDENCE:

1. Records available to the Board indicate that the applicant enlisted in the United States Army Reserve on 30 November 2001, in pay grade E-2, under the Delayed Entry/Enlistment Program. The applicant was still in High School at the time of his enlistment. He entered active duty in pay grade E-2, for a period of
4 years, on 1 August 2002.

2. Documents provided by the applicant confirm that he successfully completed a four-year JROTC program in May 2002. On 14 August 2002, shortly after the applicant entered active duty, his former JROTC Senior Army Instructor recommended the applicant for an accelerated promotion.

3. In March 2003, after the applicant had completed basic and advanced individual training, member of his first permanent duty assignment attempted to assist in promoting the applicant retroactively to pay grade E-3. Their attempts were not successful and the applicant then submitted his application to this Board.

4. In the processing of this case, an advisory opinion was provided by the Chief, Policy and Eligibility Inquiries Branch of the United States Total Army Personnel Command. It recommended that the applicant’s petition to correct his enlistment document to show that he enlisted in pay grade E-3 be approved (with a date of rank of 1 August 2002) and that he receive any financial entitlements that he otherwise would have been entitled, had his enlistment grade been correct. They noted that the applicant had completed 4 years of JROTC and received a Senior Service Instructor recommendation and as such, in accordance with Army Regulation 601-210, operational change dated 10 January 2002, paragraph
2-20b, he was authorized enlistment in pay grade E-3.

5. Attempts to provide a copy of the advisory opinion to the applicant for comment were not successful.

DISCUSSION AND CONCLUSIONS:

The evidence confirms the applicant met requirements for enlistment in pay grade E-3. His records should be corrected accordingly and he should be provided any financial entitlements that he otherwise would have been entitled, had his enlistment grade been correct.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected:

a. by showing that he enlisted in the United States Army Reserve in pay grade E-3 on 30 November 2001;

b. by establishing his date of rank as 1 August 2002; and

c. by providing him any financial entitlements that he otherwise would have been entitled, had his enlistment grade been correct.
