         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his DD Form 214 (Certificate of Release or Discharge from Active Duty), dated 2 May 1998 be corrected to show his active duty as 3 May 1994 to 2 May 1998 (4 years).

3. The applicant states that the DD Form 214 is incorrect inasmuch as he only served for a period of 4 years during the period shown above.

4. The applicant’s military records show that the applicant enlisted in the Regular Army on 3 May 1994, in pay grade E-4, for 4 years.

5. On 2 May 1998, he was honorably separated under Army Regulation 635-200, chapter 4, based on completion of required active service. His DD Form 214 incorrectly shows he was enlisted on 4 May 1990 and served 7 years, 11 months and 29 days during this period.

6. Army Regulation 635-5 (Personnel Separation Documents), indicates, impertinent part, that the DD Form 214 will be issued for the period of active service performed.

CONCLUSIONS:

1. The evidence of record clearly shows the applicant enlisted on 3 May 1994 and was separated on 2 May 1998, a period of 4 years, and his DD Form 214 should be corrected accordingly.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.


RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned entered active duty for this period on 1994 05 03 and had net active service for this period of 04 00 00.
