         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his Certificate of Release or Discharge from Active Duty, DD Form 214, be amended to add the Army Commendation Medal (ARCOM) 4th award and the Army Achievement Medal (AAM) 2d award.

3. The applicant states that he was awarded the ARCOM 4th award and the AAM 2d award after he separated.

4. The applicant’s military records show that he entered active duty on 17 August 1997. He was released from active duty on 16 August 2001. His DD Form 214 shows he was awarded three awards of the ARCOM and one award of the AAM.

5. Permanent Orders 219-012, Madigan Army Medical Center dated 7 August 2001 awarded the applicant the ARCOM for service from November 1997 through August 2001. (The Recommendation for Award, DA Form 638, shows this award, his 4th ARCOM, was approved on 24 August 2001.) Permanent Orders 267-033, Madigan Army Medical Center dated 24 September 2001 awarded him the AAM for heroism on 28 February 1998. (The DA Form 638 shows this award, his 2d AAM, was approved on 11 October 2001.)

CONCLUSIONS:

1. The evidence of record shows the ARCOM 4th award and the AAM 2d award were awarded to the applicant after he was released from active duty.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That the applicant’s DD Form 214 be amended to show he was awarded the ARCOM 4th award and the AAM 2d award.
