         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, reconsideration of his request that his military records to be corrected to show he is entitled to the Mobilization (“M”) Device for his Armed Forces Reserve Medal (AFRM).

3. The applicant states, in effect, that he was mobilized in support of Operation Desert Shield/Storm and is entitled to the “M” Device for his AFRM. In support of his application, he submits copies of mobilization orders issued to his unit in support of Operation Desert Shield/Storm.

4. The applicant’s military records show that he entered the Army on 31 January 1974, and that he was trained and served on active duty in military occupational specialty 76Y (Supply Specialist). On 28 January 1977, he was honorably separated and transferred to the United States Army Reserve (USAR). On 1 July 1983, he entered active duty in the Active Guard Reserve (AGR) program and remained on active duty in that status through continuous reenlistments until May 2000, at which time he was released from active duty (REFRAD) for the purpose of retirement, in the rank and pay grade of staff sergeant/E-6 (SSG/E-6).

5. The unit mobilization orders provided by the applicant confirm that his unit was mobilized and ordered to active duty on 30 August 1990, in support of Operation Desert Shield/Storm, and that it was demobilized and REFRAD on
24 June 1991. A roster attached to the orders contains the applicant’s name and confirms his participation with his unit during this mobilization.

6. The AFRM was established by Executive Order 10163, as announced in Department of the Army (DA) Bulletin 15, issued in 1950, and amended by Executive Order 10439, announced in DA Bulletin 3, issued 1953. This award is authorized to members for honorable and satisfactory service as a member or former member of one or more of the Reserve Components of the Armed Forces of the United States, including the Coast Guard Reserve and the Marine Corps Reserve, for a period of 10 years under certain conditions. The ten-year-device is authorized for wear on the Armed Forces Reserve Medal to denote each succeeding 10-year period.

7. Army Personnel Command Message, date/time group 231630Z, August 1996, authorized award of the Mobilization (“M”) Device for qualified personnel who were mobilized during the Persian Gulf War, Operation Restore Hope in Somalia, Operation Uphold Democracy in Haiti, and Operation Joint Endeavor in Bosnia.

CONCLUSIONS:

1. The Board notes the applicant’s contention that he is entitled to the “M” Device for his AFRM and it finds this claim has merit.

2. Regulatory guidance authorized award of the “M” for the AFRM for qualified personnel who were mobilized during the Persian Gulf War. The evidence submitted by the applicant confirms that he served with his unit during the period it was mobilized in support of Operation Desert Shield/Storm, from 30 August 1990 through 24 June 1991. Therefore, the Board finds he is entitled to receive the “M” Device for his AFRM for his service in support of Operation Desert Shield/Storm.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the applicant is authorized the “M” Device with his Armed Forces Reserve Medal; and by providing him a corrected separation document that reflects this change.
