THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his previous requests for 2nd
award of a Army Reserve Component Achievement Medal, Armed Forces Reserve
Medal with ("M") Device, Kuwait Liberation Medal, and correction of his DD
Form
214 (Certificate of Release or Discharge from Active Duty) to show his rank
as Staff Sergeant and Military Occupation Specialty (MOS) 91D30.

2.  The applicant states his former unit lost or failed to keep his
documents in his records.

3.  The applicant provides the following:

      a.  copy of his DD Form 214.

      b.  copy of promotion orders, dated 31 July 1992.

      c.  copy of Military Personnel Message (MILPER) NR 96-196, subject:
Award of the Armed Forces Reserve Medal and Mobilization ('M") Device.

      d.  copy of Military Personnel Message (MILPER) NR 96-017, subject:
Award of the Kuwait Liberation Medal-Government of Kuwait.

      e.  copy of Memorandum awarding the applicant the 2nd award of the
Army Reserve Achievement Medal, dated 12 March 1993.

      f.  copy of DD Form 4/1 (Enlisted/Reenlistment Document Armed Forces
of the United States, dated 15 July 2005.

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were
summarized in the previous consideration of the applicant's case by the
Army Board for Correction of Military Records (ABCMR) in Docket Number
AR20040002023 on 23 February 2005.

2.  The applicant enlisted in the Army Reserve for 8 years on 23 March
1985, completed active duty for training in February 1986, and returned to
his Reserve unit, the 912th MASH (Mobile Army Surgical Hospital) in Johnson
City, Tennessee, for duty as an operating room specialist.  He was promoted
to sergeant in November of 1988.  He reenlisted in the Army Reserve for 6
years on 15 July 2005, in the rank of sergeant.
3.  The applicant was ordered to active duty in November 1990 for 12 months
in support of Operation Desert Shield/Desert Storm, and served in Southwest
Asia from January 1991 to July 1991.  He was released from active duty on
17 August 1991.

4.  The applicant’s DD Form 214, administratively reissued on 10 November
2005, only reflects one award of the Army Reserve Components Achievement
Medal, the Kuwait Liberation Medal and the Southwest Asia Service Medal
with three bronze service stars.

5.  The applicant provided promotion orders promoting him to staff sergeant
and awarding him the MOS 91D30 on 31 July 1992.

6.  The applicant provided a copy of a memorandum, dated 12 March 1993,
awarding him the second award of the Army Reserve Components Achievement
Medal on March 1993 for his preceding four years of service in the U.S.
Army Reserve.

7.  Army Regulation 635-5 provides instructions for the preparation of the
       DD Form 214 and states in pertinent part that it is a summary of a
Soldier’s most recent period of continuous active duty.  It provides a
brief, clear-cut record of active duty service at the time of release from
active duty, retirement, or discharge.

8.  The applicant provided a copy of MILPER Message NR 96-196, Subject:
Award of the Armed Forces Reserve Medal and Mobilization ("M") Device.
This message states that, on 8 August 1996, the President approved an
amendment to the Executive Order that established the Armed Forces Reserve
Medal (AFRM), which authorizes award of the AFRM to members of the Reserve
Components who, on or after 1 August 1990, performed qualifying active duty
service in support of a designated contingency operation.  The mobilization
("M) device will be worn on the AFRM to denote service during a
mobilization or contingency designated by the secretary of defense.  The
"M" device was approved in 1993 by the Secretary of Defense to recognize
the special sacrifice in service to the nation of Reserve Component
personnel who volunteered or were called to active duty in support of
mobilization or contingency.

9.  The Kuwait Liberation Medal awarded by the Kingdom of Saudi Arabia (KLM-
SA) was approved on 3 January 1992 and is awarded to members of the Armed
Forces of the United States who participated in the Persian Gulf War
between 17 January 1991 and 28 February 1991.

10.  The Kuwait Liberation Medal awarded by the Government of Kuwait (KLM-
K) was approved on 9 November 1995 and is awarded to members of the Armed
Forces of the United States who participated in the Persian Gulf War
between 2 August 1990 and 31 August 1993.

DISCUSSION AND CONCLUSIONS:

1.  The new evidence provided by the applicant clearly shows he is entitled
the Armed Forces Reserve Medal with ("M") Device based on MILPER Message NR
96-196.  Therefore, it would be appropriate to add this award to his record
and separation document at this time.

2.  The applicant's DD 214 shows he was awarded the Kuwait Liberation
Medal. Records shows he participated in Operations Desert Shield and Desert
Storm.  His record should be corrected to show the Kuwait Liberation Medal
(KLM-SA) awarded by the Kingdom of Saudi Arabia and the Kuwait Liberation
Medal
(KLM-K) awarded by the Government of Kuwait.

3.  The applicant’s argument regarding his entitlement to the Army Reserve
Components Achievement Medal was also carefully considered.  However, he
was awarded the second award of the Army Reserve Components Achievement
Medal for the four-year period ending in March 1993, after his release from
active duty on 17 August 1991.  He did not earn that award until March
1993.  Therefore, amendment of the original Board decision on this issue is
not warranted.

4.  The applicant was promoted to staff sergeant and awarded the primary
MOS
91D30 on 31 July 1992, after his release from active duty on 17 August
1991.  He did not get promoted and awarded the MOS until 31 July 1992;
consequently, it cannot be shown on his DD Form 214 of 17 July 1991.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
amendment of the ABCMR’s decision in Docket Number AR20040002023, dated 23
February 2005.  As a result, the Board requests that the CMSD-St. Louis
administratively correct the DD Forms 214 of the individual concerned by
adding the Armed Forces Reserve Medal with ("M") Device, delete the Kuwait
Liberation Medal and add the Kuwait Liberation Medal (KLM-SA) and Kuwait
Liberation Medal (KLM-K).

2.  The Board further determined that the evidence presented is
insufficient to warrant a portion of the requested relief.  As a result,
the Board recommends denial of so much of the application that pertains to
the 2nd award of the Army Reserve Components Achievement Medal, promotion
to Staff Sergeant and MOS change.
