PROCEEDINGS

         IN THE CASE OF:

         BOARD DATE: 5 March 2002
         DOCKET NUMBER: AR2001063684

I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual.

Mr. Carl W. S. Chun Director
Mr. G. E. Vandenberg Analyst

The following members, a quorum, were present:

Mr. Fred N. Eichorn Chairperson
Mr. Thomas B. Redfern III Member
Mr. Donald P. Hupman, Jr. Member

The applicant and counsel if any, did not appear before the Board.

The Board considered the following evidence:

Exhibit A - Application for correction of military
records
Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.

2. The applicant requests that his DD 214 (Certificate of Release or Discharge from Active Duty) be corrected to show the receipt of the National Defense Service Medal.

3. The applicant states that his records show that he earned the medal and that he had worn it his entire period of service.

4. The applicant entered active duty on 10 January 1992, attained the rank of staff sergeant and completed a Bachelor of Arts in 1999. He was separated with an honorable discharge on 02 April 2000. His DD Form 214 does not list the National Defense Service Medal.

5. Army Regulation 600-8-22 provides, in pertinent part, that the National Defense Service Medal was awarded for honorable active service during the period from 2 August 1990 through 30 November 1995.

CONCLUSIONS:

1. The evidence of record shows that the applicant served honorably during the above period for which the National Defense Service Medal was authorized and should be reflected on his DD Form 214.

2. In view of the foregoing findings and conclusions, correcting the applicant’s records as recommended below would correct an error.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected to show that the individual concerned is authorized the National Defense Service Medal by adding it to his DD Form 214.
