         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that certain blocks of her enlistment document (DD Form 4/1 and 4/2) be corrected, and that a correct DD Form 4/1 and 4/2 be substituted therewith.

3. The applicant states that she reenlisted in the Army Reserve on 21 February 2001 and her commander duly signed and dated her DD Form 4/2 (block 19f). The unit’s service representative entered the date that she prepared the enlistment document, 20 February 2001 (block 14f) . The applicant states that she neglected to enter the dates that she reenlisted, noticed the oversight prior to mailing the document, and entered the date of 1 March 2001, the date that she mailed the document, in blocks 5, 13c, and 18b instead of her reenlistment date of 21 February 2001. The applicant submits statements from her commanding officer and unit clerk attesting to the fact that she reenlisted on 21 February 2001.

4. The applicant also submits a “CORRECTED COPY” of the DD Form 4/1 and 4/2 with all blocks dated to show she reenlisted on 21 February 2001.

5. There are no military records available other than those mentioned above.

6. Army Regulation 140-111 provides instructions for preparation of the DD Form 4 series and states in paragraph 5-10 that a correction to the term of service or the effective date of reenlistment agreement is prohibited. The soldier must petition the ABCMR for correction consideration. That paragraph goes on to say that the applicant’s commander may correct administrative or typographical errors that will not affect the term of service or the effective date of the enlistment document by preparing a new DD Form 4 series, correcting all previous errors and placing the words “CORRECTED COPY” at the top and bottom of each page of the DD Form 4 series.

CONCLUSIONS:

1. The applicant reenlisted in the Army Reserve for three years on 21 February 2001. Her enlistment documents should reflect that information.

2. The applicant’s request to substitute a “CORRECTED COPY” of the DD Form 4 series in lieu of the original DD Form 4 series is not accepted. A corrected copy is authorized only to correct administrative or typographical errors that do not affect the term of enlistment or the effective date of the enlistment document.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.


RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by showing that she reenlisted in the Army Reserve for three years on 21 February 2001, and consequently blocks 5, 13b. 14f, and 18b should reflect that date.

2. That so much of the application as is in excess of the foregoing be denied.
