      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that his DD Form 214 (Report of
Separation from Active Duty) with an effective date of 20 December 1974 be
changed to show that he entered active duty on 30 November 1970 instead of
31 August 1972.

2.  The applicant states, in effect, that his DD Form 214 shows that he had

only 2 years, 3 months and 20 days of active service.  The applicant states
that the dates on the DD Form 214 are incorrect and do not match his
medical records which show that he  served from 30 November 1970 through
20 December 1974.  The applicant further states that he was in Vietnam
during the period from 23 September 1971 through 23 March 1972.

3.  The applicant provides a copy of:

      a.  his DD Form 214;

      b.  his DA Form 20 (Enlisted Qualification Record); and

      c.  his Department of Veterans Affairs (DVA) Rating Decision, dated
17 May 2001.

CONSIDERATION OF EVIDENCE:

1.  The applicant is requesting correction of an alleged error which
occurred on 20 December 1974, the date of his discharge.  The application
submitted in this case is dated 10 February 2005.

2.  Title 10, U.S. Code, Section 1552(b), provides that applications for
correction of military records must be filed within 3 years after discovery
of the alleged error or injustice.  This provision of law allows the Army
Board for Correction of Military Records (ABCMR) to excuse failure to file
within the 3-year statute of limitations if the ABCMR determines that it
would be in the interest of justice to do so.  In this case, the ABCMR will
conduct a review of the merits of the case to determine if it would be in
the interest of justice to excuse the applicant’s failure to timely file.

3.  The applicant's military records show that he initially enlisted on 30
November 1970 for a period of 3 years.  He had no prior active or inactive
service.

4.  On 30 August 1972, the applicant was discharged for the purpose of
immediate reenlistment.  He had completed 1 year, 9 months, and 1 day of
active service that was characterized as honorable.  The highest grade held
by the applicant was specialist four/pay grade E-4.  The records do not
contain a
DD Form 214 for this period of service.  The records do contain an unsigned
Certification of Military Service, dated 21 February 1980, for the period
of service from 30 November 1970 to 30 August 1972 that shows service was
terminated by honorable discharge.

5.  On 31 August 1972, the applicant reenlisted for a period of 6 years.
On 20 December 1974, the applicant was discharged with a general discharge.
 He had completed 2 years, 3 months, and 20 days of active service that was
characterized as under honorable conditions.

6.  The following entries are contained on the DD Form 214 that was issued
for the period 31 August 1972 to 20 December 1974:

      a.  Item 15 (Date Entered Active Duty This Period) - 72 8 31 (31
August 1972);

      b.  Item 18a (Net Active Service This Period) - 2 3 20 (2 years, 3
months, and 20 days;

      c.  Item 18b (Prior Active Service) - 0 0 0;

      d.  Item 18c (Total Active Service) - 2 3 20;

      e.  Item 18d (Prior Inactive Service) - 1 9 1 (1 year, 9 months, and
1 day); and

      f.  Item 19 (Indochina or Korea service since August 5, 1964) - the
"yes" block contains an "x" and the dates 23SEP71-23MAR72 are shown.

7.  Army Regulation 635-5 (Separation Documents) establishes the
standardized policy for preparing and distributing the DD Form 214.  This
regulation states that a DD Form 214 will be prepared for all personnel at
the time of their retirement, discharge, or release from the Active Army.

8.  Army Regulation 635-5, then in effect, provides for the entries in the
items indicated:

      a.  Item 15 - enter date entered this period of active service;

      b.  Item 18a-d - all service shown will be less time lost; and

      c.  Item 19 - for Vietnam service place an "x" in the "yes" block and
show specific dates of service.

9.  Army Regulation 635-5, currently in effect, states that a DD Form 214
will not be issued to replace record copies or DD Forms 214 lost by
Soldiers.  This regulation further states that if no DD Form 214 is
available, a statement of service or transcript of military record may be
issued.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that the dates on his DD Form 214 are incorrect
and do not match his medical records which show that he  served from 30
November 1970 through 20 December 1974.  The applicant further states that
he was in Vietnam during the period from 23 September 1971 through 23 March
1972.

2.  The applicant's DD Form 214 for the period of service from 30 November
1970 to 30 August 1972 is not available in the records nor was a copy
provided by the applicant.  However, it must be presumed that a DD Form 214
was issued to cover this period.  Since Army regulations prohibit issuing a
replacement
DD Form 214, a statement of service should be issued to cover the period
from 30 November 1970 to 30 August 1972 with a signed copy to be retained
in the file.

3.  The date of the applicant's reenlistment, 31 August 1972, is the
beginning of a new period of active service.  Therefore, the date in Item
15 is correct.

4.  Computation of the applicant's net service for this period of service
is 2 years, 3 months, and 20 days.  Therefore, the entry in Item 18a is
correct.

5.  The applicant had completed 1 year, 9 months and 1 day of active
service prior to 31 August 1972.  Therefore, Item 18b should be amended to
read 1 9 1.

6.  Computation of the applicant's total active service, by adding the
service in Item 18a and Item 18b, shows the applicant had a total of 4
years and 21 days of active service.  Therefore, Item 18c should be amended
to read 4 0 21.

7.  The records do not show that the applicant had any prior inactive
service.  Therefore, Item 18d should be amended to read 0 0 0.

8.  Based on the applicant's dates of service in Vietnam shown, the entry
in
Item 19 is correct.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to
warrant a recommendation for partial relief and to excuse failure to timely
file.  As a result, the Board recommends that all Department of the Army
records of the individual concerned be corrected by issuing the applicant a
statement of service for the applicant's service from 30 November 1970 to
30 August 1972.  The statement of service should show that the applicant
was honorably discharged and that his last grade was specialist fourth
class.

2.  The Board further recommends that all Department of the Army records of
the individual concerned be corrected by making the following changes to
the applicant's DD Form 214, with an effective date of 20 December 1974:

      a.  amending Item 18b to read 1 9 1 instead of 0 0 0;

      b.  amending Item 18c to read 4 0 1 instead of 2 3 20; and

      c.  amending Item 18d to read 0 0 0 instead of 1 9 1.

3.  The Board further determined that the evidence presented is
insufficient to warrant a portion of the requested relief.  As a result,
the Board recommends denial of so much of the application that pertains to
the date he entered on active duty.
